Heather Mallory's Case Remains Unsolved







March 7, 2008 is a long time for the family of Heather Cole from Portland, Oregon who went missing nearly 27 months ago, to continue without answers.

For families of unsolved or missing persons ,time on a clock literally stands still the moment they receive information a loved one is missing or has been found dead.

Brian Cole, Heather’s husband, and their 5-year-old son have since moved from the Portland Oregan area and now live somewhere Idaho. Her body was never been found, but police think she is dead. I should also mention Brian, her husband, failed a lie detector test last year, but as any defense attorney worth their salt would tell you, taking a lie detector does not mean a person is guilty of a crime.

According to the husband, he informed police Heather Mallory stayed out all night partying on March 7th and came home to her southeast Portland apartment the next morning.


Her husband, Brian Cole, confronted her about her all-nighter. That was the last known time anyone saw Heather alive and Cole says she left after the argument. I should also report that she was four months pregnant. Another case, in my opinion, where a person with possible motive is the only one to have a story and the last to see the person who vanished alive. As we all know, a mother never, ever just leaves their child behind.

Police think she’s dead but have yet to find a body. Her car was found abandoned, and her cell phone has had zero activity, as well as as her credit card. Steve and Jeni Mallory—Heather’s parents—talk to police every week hoping something turns up. But. in these cases when there are no witnesses or if someone did see or hear something, they often talk themselves out of coming forward. It makes it difficult for law enforcement to continue investigating a case. It goes cold and sits in a dark file cabinet until a new pair of eyes reviews the case or a reporter does a follow-up to a story.



It is worth mentioning the couple allegedly had marital problems with the police reposnding to a domestic call for help in the home and Heather securing a court order of protection.

Brian Cole remains only a person of interest.

No one had the right to take her life and we have a responsibility in these cases to seek justice for those who are no longer able to speak for themselves. Drew Peterson Defense Adds New Members To The Already Crowded Circus Ring?













According to reporter Joe Hosey and author of the book Fatal Vows who has been covering the Drew Peterson case since 2004, the total number on the defense team is now up to six.

In my opinion, of note joining the team, or should I say "train wreck," is defense attorney and legal commentator Steven A. Greenberg. I am surprised because of Greenberg’s criticisms in the past to my favorite legal marshmallow roaster (notorious for passing out monogrammed pens and handing out chicken wings with sauce to reporters) because he couldn’t control the client

I happen to know Greenberg from other cases through the years. He is one of Illinois more skilled defense lawyers. So why is he wasting his talent and representing the former Bolingbrook police Sergeant?

In an interview over a year ago ,and as a legal commentator, defense attorney Steve Greenberg, who has analyzed the Peterson saga for national news shows--
"The second Savio autopsy is just a different interpretation of the injuries," he said. "The same injuries were documented in the first one, but what apparently happened is it was treated differently because Drew Peterson was a police officer. It's just a fact that authorities at the time took his story and didn't really look into it."
Greenberg said he doesn't expect Glasgow will undercut his own case by running from the first autopsy, however.
"He'll say, 'That was just that pathologist's opinion at the time, but it's really up to you to decide,'" he said. Glasgow will then point to the injuries noted in both autopsies and ask the jury to use common sense.
"He'll ask, 'Do you think that someone who falls in a bathtub would have 17 bruises on their body?"

In my opinion this one is all about the media gravy train. I’ll bet a dozen pair of pantyhose Steven Greenberg has taken this case pro-bono.

Regardless, Greenberg wins either way and has nothing to lose by being part of the already crowded circus act. Wish there was a way to put an attorney on the stand when they make "expert in their opinion" remarks
and hold them accountable. Reminds me of another attorney Mark Geragos.

Rachel Anderson Was A Target of Stalker?



"The past three months have been a nightmare for her (my mother pictured left is 40- year old Rachael Anderson from Claskston, washington) . She was a victim of stalking and feared for her life. The stalking compelled her to sleep in the living room of her home with the lights on instead sleeping in her own bedroom. Many times she would have a friend stay over with her because she was so scared.

The stalking began three months ago with phone calls. At first with the phone calls, no one would respond. The phone calls progressed into music playing in the background, that was muffled, and no one would speak on the phone. Then she started getting phone calls from various telephone numbers with disguised voices. The disguised voices would tell her what she was doing, what specific lights were on in her home, as if every move she made was being watched.

During this time my mom had the lock to her shed broken off, eerily men’s cologne was present on her front porch at night, her vehicle tires were slashed in front of her home, and the back windshield of her vehicle was broken in broad daylight at the parking lot of her employer. She had reported this information to law enforcement as she feared for her life. Multiple police reports were filed and she was working with a police detective with whom she checked in with everyday. On the day that my sister and I reported our mother missing, our mother was supposed to meet with detectives to try and find out who was stalking and harassing her. Interestingly, my mother also had documented information which she was compiling together that is now missing.


With the search for my mother, the vehicle she was last seen driving was located on Wednesday, April 21, 2010. The vehicl
e was located at a local gas station/bus stop. During the search for my mother, law enforcement has issued search warrants. A building she was last seen in on Friday, April 16th was one of the locations that a search warrant was executed. On Monday, April 26, 2010 the FBI is supposed to become involved with this case.


My mother is a strong, intelligent, vivacious woman who everyone loves and misses dearly. She has two young sons who live with her and are heartbroken by her disappearance. We all need her home safely. Please help us in our search!"

My Thoughts on this case:
This sounds as if the woman knew her stalker. Perhaps she dated him and broke off the relationship. It could be that she wasn't interested in this person and he wanted to get her attention by stalking her and making his presence known by slashing her tires, calling and even going through the home when she was gone.

Many victims of stalking are fearful that if they report somesome stalking them the harassment will increase. But in Rachael Anderson's case she was working with police detectives and checked in with them daily. Often innocent family members are threatened or targeted by the stalker. But in many cases, not taking action either by going to the police, taking pictures and, yes, even preparing an evidentuary abuse document and video even if you are stalked does leave authories and family members with important answers should a loved one suddenbly vanish.

The above posting came from the woman's daughter on Myspace. Another disturbing incident is the fact that cologne was spilled intentionally on the front porch of Racheal Anderson's home. Similar to a dog leaving their scent, announcing to a victim they were there at the home, once again. Stalking is a sick game a predator plays with their victims similar to "catch me if you can."

The family and law enfoprcement are looking for any information that will lead them to this missing mother. The police found her car and, as we all know from other cases, that is not a good sign. If you live in the area pass out flyers or ask people in the community to help spread the word.

Could "Time's Up" have helped Monica Beresford-Redman before it was too late?




The moment I heard the news that former television producer of the show "Survivor's"wife, Monica Beresford-Redman ,had been found dead of strangulation in a sewer while the couple and their children were vacation, my heart sank. I knew there was more to this tragic end than was being reported.

The sister of the slain wife of "Survivor" producer, Bruce Beresford-Redman, said, "he had been having an affair, and that the couple went to Mexico to patch things up.” I realize the toxicology reports and other DNA results are not back yet, but, this walks, talks and smells, in my opinion, like premeditated murder.


Abusers are clever in every aspect when it pertains to harming those in their lives. Think about it for a moment. He is allegedly having an affair with someone outside the marriage. His mind is clearly not on his wife or children. Maybe the person with whom he is having an affair says something like “unless you leave your wife and kids, we are history.” Or perhaps Bruce Beresford Redman is in love with this person and decides the easiest way out of his marriage is to take Monica on a planned trip out of the country for a “second honeymoon.” Considering he traveled the world as a producer it is likely he would have an idea of the best place to go without raising any eyebrows. Bruce makes Monica believe the affair has ended and he wants to recommit to his love for Monica and the kids. She informs family and friends they are taking a trip in hopes of patching things up.

In the mind of an abuser, the main objective in the majority of intimate violence homicide's is to remove the obstacle, allegedly, in this case, the mother of his children and wife Monica, all together from his life.

Monica Beresford-Redman in my opinion did not have a chance in hell for survival once she got on that plane. I have to believe that somewhere in her gut she knew something wasn’t right with the trip and on good faith went ahead anyway hoping their lives would get back on track. Domestic violence homicide is no longer a single act of heated rage or an isolated incident. It is an epidemic, and we can expect more mothers, sisters, community members and co-workers to lose their lives at the hands of those who profess to love them.

In my opinion, had Monica Beresford completed an Evidentiary Abuse Affidavit document and video (example show above) prior to her getting on that plane to Mexico, the person responsible would be arrested and charged with her murder.

If you learn anything from this site it is to be on guard if you are in a relationship with an abuser. Before you take a trip or announce you are ending the relationship or filing for divorce, as a safety precaution, you must prepare an Evidentiary Abuse Affidavit document and video. In the event something happens to you at least you have prepared documentation in advance, just in case you do suddenly go missing or discovered as too many women are, dead.

Supreme Court Ruling " Applicant's Admission Denied"





Today, the Nebraska Supreme Court gave a voice to three intimate officer involved victim's of abuse over a nine year period whom were each ( all sought court orders of protection) at the center of what I believe is the first ever denial of a former police officer. The supreme court decision is based on his alleged abusive acts against the victims and other behaviors. He was denied admission to sit for the Nebraska State Bar Exam.

The Supreme Court decision was carefully based on the following criteria set forth before anyone can take the bar exam and become an attorney:

"4. Attorneys at Law. Where the record of an applicant for admission to the Nebraska State Bar demonstrates a significant lack of honesty, trustworthiness, diligence, or reliability, a basis may exist for denying his or her application.
5. ____. When evidence exists to indicate that an applicant has engaged in conduct demonstrating a lack of character and fitness, the Nebraska State Bar Commission must determine whether present character and fitness qualify the applicant for admission."



The Allegations Against Former police officer Anthony Ybarra were prior to his attending law school.

Anthony Ybarra worked as a police officer with the Scottsbluff Police Department from December 1997 to March 2003. During this time, Ybarra had an intimate relationship with a woman. The relationship ended in August 1999. In August 2001, D.G. twice filed a petition for a protection order against Ybarra. In an affidavit in support of one of the protection orders, the woman reported incidents of Ybarra’s harassing her.

On April 22, 2001, Ybarra arrested the woman for driving under the influence (DUI). According to the victim, Ybarra was sitting in his patrol car outside a bar when his former girlfriend left the bar. Then Officer Ybarra followed her for more than a mile and turned on his patrol car’s overhead lights when she stopped at her sister’s house. The woman was not concerned at first because officerYbarra had previously pulled her over on a number of occasions to talk to her and ask her to go to lunch. Instead, Officer Ybarra administered field sobriety tests and then arrested the woman. After she posted bond and returned home at 4 a.m., The victim found offficerYbarra waiting for her. Ybarra then entered her house without permission. She asked him to leave, indicating that if he did not, she would call the police.

In my opinion, and in true abuser style, the partol sergeant employed with the Scottsbluff Police Department Ybarra, said, “‘I am the police’” and left. He subsequently called the woman from his patrol car. She told him she had nothing to say and hung up. The woman said she believed officer Anthony Ybarra was using his authority to intimidate her.

And, of course, it would be Anthony Ybarra telling a different version of the events of that evening. Sounds like a few others who suffer from the same behavior pattern we read about, wouldn't you agree?

"The Commission thus found Ybarra lacked the ability to demonstrate honesty and integrity; to act in accordance with the law and the rules of ethics; to exercise good judgment; to avoid acts that show disregard for the health, safety, and welfare of others; and to conduct himself professionally. The record shows a history of behavior which is abusive, violent, hostile, intimidating, threatening, assaultive, unlawful, and perverted. The record shows that Ybarra does not meet the standards of character required to be admitted to the bar."

CONCLUSION As Per the Supreme Court (upholding the decision of the commision is as follows:
Ybarra’s behavior demonstrates a pattern of abhorrent behavior toward women. Three women in the past 9 years have sought protection orders against him. He has not admitted that his behavior is inappropriate and has not demonstrated any remorse. The Commission was correct in determining that Ybarra does not meet the standards of character required for admission to the bar and that he should not be allowed to take the state bar examination. We affirm the Commission’s denial of Ybarra’s application to take the Nebraska bar examination.(in re application of ybarra 759 Cite as 279 Neb. 758Nebraska Advance Sheets 760 279 nebraska reports)


In my opinion, the former officer's behavior literally came back to bite him in the ass. After many years of dealing with intimate officer violence in the home, I cannot recall a more timely victory on behalf of all those whose cries for help fell on deaf ears!

Domestic Violence by Police Officers: "Zero Tolerance"

I checked the definition of "Zero Tolerance" before I began this article and it means "any policy that allows no exception."

Private law enforcement Web sites around the country and the Fraternal Order of Police are in an uproar over Pittsburg Mayor Luke Ravenstahl's decision to enforce the zero tolerance policy for domestic violence by police officers.

The case is over the firing of Former Sgt. Eugene Hlavac an 18-year veteran of the police force who back in December of 2009 lost his job for assaulting the mother of his child and former girlfriend. According to court documents, the former officer was in his police uniform and, in my opinion, likely wearing his police issued weapon and oh, should I mention he practically dislocated her jaw during the incident.

Former Officer Hlavac, had been charged with simple assault for slapping his former girlfriend was found not guilty earlier this week by a judge, based largely on the testimony of a lone witness, who said that Mr. Hlavac appeared to strike his former girlfriend in self-defense after she "started to beat on the officer," the judge said. The lone witness who lives across the street from Mr. Hlavac and saw the confrontation from her car parked outside, testified that Ms. Maughan "was in a rage" and "attacked" him, Judge Flaherty said. Mr. Hlavac struck her in what the wtiness described as "an instantaneous push-away," according to the judge. "She said she didn't believe he intended to hurt her, it was in a defensive mode," he said. The witness does not know Mr. Hlavac, nor did she know he was a police officer, the judge said. "She just seemed very credible," Judge Flaherty said. "She did not strike me as the kind of person who did not tell the truth."



Because the officer was found not guilty earlier this week his lawyer will meet with the arbitration board for a hearing in hopes of restoring the officer's job with full back pay. But, this is where the case, in my opinion, gets a little sticky. You know what I mean, like gum stuck at the bottom of a good pair of shoes and you just can't get it off.

The police depatrtment fired former officer Hlavac, not because of the criminal case, but because he broke police policies or rather the "zero tolerance" as per the departments code and failure to follow the law enforcement code of ethics.. Unless, maybe at the hearing the former officer gets "grandfather" " privileges because the policy went into a affect after he was sworn in and given his police commission. Now there is a healthy arugment for his defense attorney "policy immunity."

I also should point out that the city's burden of proof in arbitration is lower than a prosecutor's burden in a criminal case.

According to the newspaper, the Mayor was quoted as saying,"the verdict doesn't mean no wrong was done or that there won't be consequences." I love that word consequences especially when it pertains to the accountability of a sworn officer who abuses their position of authority.

Before I get a lot of nasty private emails from my fan club of defense attorneys and law enforcement officers, let me make it very clear; yes, there are two sides to every story. Yes, the officer was acquitted of all charges. But, in my opinion, he should not be allowed back on the police force.

Again, my opinion is based on far too many of these officer related domestic violence cases that I am involved with on a daily basis (most involve a tragedy after the fact). Chances are this was not the first incident between the former officer and his girlfriend. It is however likely this was the first reported and documented incident of violence. Victims involved with officers rarely proceed and press charges. Most involved with officers who are abusive are in fear for their lives and we read about them after the fact because they are afraid of being killed so they suffer in silence. Women like Charoltte Grahn, Kathleen Savio, Theresa Parker, Sonia Garcia, Sandy Silcox, Lori DeKleine, Jessie Raponi, Tera Chavez, Carli Dennis, Barbara Vanaman, Crystal Brame and Stacy Peterson to name only few allegedly killed by their abusive officer husbands.

Who knows, perhaps if other law enforcement agencies adopted a zero tolerance policy maybe fewer officers wives and girlfriends would not end up being visited by loved ones bringing flowers to their grave sites.

Drew Peterson Trial "I Practiced On One and Perfected On The Other?"

















It was nice of the captain ( the judge on the Drew Peterson case) to allow the passengers to leave the trial ship gracefully. The Will County, IL, court in my opinion provided life rafts for a quick exit with their excellent legal reputations in tact.




The Peterson Story Wordpress site, also known as Justice Cafe, (the only site reporting and following the Peterson case) emailed attorney Andrew Abood of Abood Law and asked him if he wanted to comment on Wednesday's motion to withdraw from the defense team of Drew Peterson. The site administrators specifically asked about the mention in Christy Gutowski’s story for the Daily Herald of a "suicide defense." The full article is HERE.

In my opinion, if Drew Peterson were to be acquitted ( I pray that does not happen) by a jury, will his legal marshmallow roaster have a pocket full of monogramed ink pens and a box of chicken wings with sauce under his arms as he attempts to meet with book publishers to secure a book deal for his client?

What would the name of the book be titiled? In my opinion, it should be called "I Practiced On One And Perfected On The Other."

Van Zandt spent hours with Koresh, working diligently to pierce his veil of spirituality, trying to make sense of his wild ramblings while at the same time trying to talk some sense into him. Koresh addressed Van Zandt as “Brother Clint” because he knew Clint was a practicing Christian. Van Zandt says this drawn out ordeal took an emotional toll on him at a time in his career when he was “one fuse short of burning out.”

Joseph Hosey author of the acclaimed book "Fatal Vows The Tragic Wives of Sergeant Drew Peterson." Hosey has been a reporter for the Chicago-area's Herald News since 1999 and has been on the cusp of every major development in the Drew Peterson case. He is the only member of the media to cover Kathleen Savio's inquest, and he broke the stories of her death as well as Stacy Peterson's disappearance.

Steph Watts producer, blogger and has done investigative work with Mark Fuhrman for OTR at FOX News on the disappearance of Stacy Peterson was seminal. She was the fourth wife of Bolingbrook Police Officer Drew Peterson, and prime suspect in her disappearance. This work led to the reclassification of the death of Peterson’s third wife Kathleen Savio, from an accident to a homicide.

And Pastor Neil Schori from the Naperville Christian Church will be with us for the entire hour. Pastor Schori is also a national advocate for victim's of abuse and stalking.

Susan Murphy Milano Hosts Kristina Korobov

Senior Attorney for the National Center for the Prosecution of Violence Against Women, a division of the National District Attorney’s Association, Kristina Korobov will be the guest for the enitre hour of  The Susan Murphy Milano Show,Wednesday, April 7 at 4pm Eastern, 3pm, Central on BlogTalk Radio.

Ms. Korobov served as an Assistant Commonwealth’s Attorney with the Loudoun County Commonwealth’s Attorney in Leesburg, Virginia, a suburb of Washington, DC.  She handled all Domestic Violence and Physical Child Abuse Cases and was responsible for Law Enforcement Training.  Kristina was a member of the Loudoun Domestic Abuse Response Team (DART) and she chaired the Child Protection Team Subcommittee of the DART.  Kristina came to Virginia from Indianapolis, where she was the Coordinator of the Indianapolis Violence Reduction Partnership, an initiative funded by the United States Department of Justice.  Prior to that, Korobov served as Chief Counsel for Strand Analytical Laboratories, a private DNA Lab in Indianapolis.  From 1996 until 2005, Kristina worked in the Marion County (Indianapolis) Prosecutor’s Office.  She served as Chief of the Sex Crimes and Child Abuse Unit, Chief of the Domestic Violence Unit and as a Major Felony Prosecutor.

In addition to handling cases, Kristina was responsible for attorney supervision and training, policy development, community outreach and training for law enforcement officers.  Among other cases during her tenure, Korobov prosecuted Marion County’s first Repeat Sex Offender, a police officer who was manufacturing child pornography, and serial rapist Charles Hill.

In 2002, Kristina was named Prosecutor of the Year by the Indiana Coalition Against Sexual Assault and received an Outstanding Lecturer Award from Communities Against Rape / Center of Hope for Youth.  Defense attorneys refer to Ms. Korobov as the “Queen of Pain” and the “Princess of Darkness.”
