Fear-Murder-Cover-Up-Corruption on Anna Maria Island in Florida

The walls inside the rooms at the landmark Bridge Walk Resort on Anna Maria Island in Florida were apparently thin enough for guests in adjacent rooms to hear arguing and fighting.  A call to 911 for assistance was made not by Sheena Morris age 22, but, the guests in the next room because they were in fear for the woman's life.  January 1, 2009 Bradenton Beach Police Department responded to the call for help placed by the guest. Instead of doing their job, making a domestic battery incident report, per the law, the officer's turn around accusing Sheena of being a prostitute, treating her like a criminal.  The officers did not believe a word of her story, they left.  The manager of the resort also responded by informing Sheena's boyfriend, that behavior would not be tolerated and asked that he leave.

At 2:05 PM Sheena places a call herself to 911.

This report of the first 911 call by the guest was not filed until approximately two days later.  More of a cover-one's-behind report, after she'd already been found dead.

Normally there isn't much happening on Anna Maria Island in the off season, except for people who've had too much to drink.  It's a slow night for Bradenton Beach police detectives so the ones stuck working that evening have themselves a poker party in the station until their shift is over in the morning.  Going on a call to a homicide, after they've celebrated a bit themselves can make for some grumpy detectives.  This equals sloppy police work on the crime scene.  Because Sheena is especially attractive, they too arrive at the wrong conclusion and her death is handled as a suicide.

At 22 years of age the life of Sheena Morris was abruptly hijacked as a direct result of intimate partner homicide.

When the medical examiner changes the death certificate of Sheena Morris from suicide to undetermined, Bradenton Beach police detectives tell her mother they aren't re-opening the investigation.

The Susan Murphy Milano Show: "Paradise at Anna Maria Island Ended in Murder"

Anna Maria Island is located on the Central West Coast of Florida, tucked in between the tropical blue waters of Mexico to the West and Tampa Bay to the North. It's not just amazing vacation spot and where couples around the globe plan their wedding, but, Anna Maria Island is the home of an unsolved homicide.

The case is unsolved for only one reason, the Bradenton Beach Police Department, one detective in particular, refuses to allow the case to be re-opened.  In March of 2011, the medical examiner changed the death certificate of Sheena Morris from suicide to "undetermined."  This is new information and warrants this case to be properly investigated.

On January 1, 2009 Sheena Morris was found, deceased, in a hotel room at the Bridge Walk Resort in Anna Maria Island, Florida.  According to crime scene photos, and Dr. Michael Baden and Dr. Michael Berkland expert opinions, Sheena Morris was murdered; the bathroom where she was found a "staged crime scene."  


This time of year is Anna Maria Island's biggest season. Tourists from around the country bring their families to this amazing vacation paradise. Couples spend their honeymoon on the beaches. Shops and restaurants benefit from the dollars spent by the visitors.

Sheena Morris was a visitor, as matter of fact the Island was her favorite place to vacation or get-a-way for a few days. But, she never left the island, a victim of intimate partner violence that lead to homicide. Sheena was taken out in a body bag from her room at the Bridge Walk Resort.  




Tourism dollars also pay for the salaries of the Bradenton Beach Police Department. Comforting isn't it, a murderer known to detectives is sharing the beaches with the tourists this summer, perhaps buying you a round of drinks at a popular island bar or restaurant, or, if you own a home, laying your carpet.

Domestic violence or intimate partner victims now are able to provide information, in their own words, about the fears, dangers, experiences they have had at the hands of their abuser. The" Evidentiary Abuse Affidavit" or "EAA" records victim's stories, histories, and experiences which are preserved and stored on their behalf. These videos will provide answers to the many questions, allegations, and fears that arise when a person has disappeared, gone missing, or been found dead.

Recent cases, such as missing mother Susan Powell of Utah, Renee Pernice of Kansas, Kelly Rothwell of Florida, Jacque Waller of Missouri and women like Stacy Peterson, where the victim’s police officer husband is the person of interest, is the classic example of the benefits of this type of evidence. Case concerning the right to confront and prove intent to prevent the witness from testifying

Giles v. California, 554 U.S. 353 (2008)

Facts of the Case
When Dwayne Giles was tried in state court for the murder of his ex- girlfriend, he claimed self-defense. Giles stated that he had heard her vow to hurt him and a friend, and that she had previously shot a man and threatened people with knives. The prosecution then introduced evidence of a conversation between Giles' ex-girlfriend and police in which she claimed that he had assaulted her and threatened to kill her. The district court eventually convicted Giles of murder.

On appeal, Giles argued that use of the police conversation violated his Sixth Amendment right to confront witnesses against him, namely, his deceased ex- girlfriend.

The California Supreme Court held that Giles had waived this right because he was the cause of his ex-girlfriend's absence. Although this exclusion was justified under common law rules of "forfeiture by wrongdoing", the Supreme Court had greatly constrained the admissibility of such evidence in its 2004 holding in Crawford v. Washington. Crawford essentially wiped out the admissibility of such out-of-court statements unless the testimony could be subject to cross-examination at trial, an option that would be impossible under these circumstances. This case gives the Court an opportunity to expand on its decision in Crawford and to apply it to a situation where the wrongdoing that kept the witness from appearing in court was not motivated by a desire to prevent the witness' testimony.

Question
Are a criminal defendant's rights under the Confrontation Clause of the Sixth Amendment violated when the common law "forfeiture by wrongdoing" doctrine is applied to allow out-of-court statements made by a witness, absent due to the defendant's own conduct, into evidence without giving defendant an opportunity to cross-examine the absent witness?

Conclusion
Yes. In a 6-3 decision, the Court held that the forfeiture by wrongdoing exception only applies to situations where the defendant causes the witness' absence with the intention of preventing that witness from testifying at trial. Without this intention, any act by the defendant making the witness unavailable does not waive that defendant's Sixth Amendment right to confront and cross-examine the witness, and therefore any out-of-court statements made by the witness are inadmissible as evidence. Justice Antonin Scalia delivered the opinion of the Court.

Justice Clarence Thomas wrote a concurring opinion stressing his belief that statements such as those made by the witness in this case should not implicate the Confrontation Clause at all because the police questioning was not a "formalized dialogue." Justice Samuel Alito also wrote a concurring opinion suggesting that the witness' statements, in his view, did not fall within the Confrontation Clause but noting that neither party had made this argument before the Court. Justice David Souter, joined by Justice Ruth Bader Ginsburg, concurred in all parts of the majority opinion except one section denouncing the dissenting argument. Justice Souter stated that he did not find the dissent as wrongheaded as the majority suggested.

The dissent, written by Justice Stephen Breyer and joined by Justices John Paul Stevens and Anthony Kennedy, argued that a defendant loses his right to confrontation when he makes a witness unavailable due to his own wrongdoing, even if he did not act with the specific intention of preventing her from testifying at trial.

What is Court Watch Brevard?

Court Watch Brevard is a domestic violence gender bias education and awareness program for students, the community, and for judges. We observe and evaluate the criminal and civil justice processes, involving cases of domestic violence in Brevard County, Florida and the United States.

Through the use of volunteers, the program monitors compliance with domestic violence statutes and provides a forum for feedback to facilitate system change.

Holding a Higher Standard in Officer Involved Intimate Partner Violence Cases

"This incident definitely tears us apart," Lauderhill Police Capt. Constance Stanley said, describing the effect on the force's 120 sworn officers. "There are a lot of mixed feelings because each of the officers has friends in the department." source The Palm Beach Post......

Officials in Broward County indicate this has never happened until now where a fellow officer empties their Glock into the vehicle of another. Why? Because Officer Brittny Skinner continued to reject him. They briefly dated when she joined the force in 2006, but the single mother broke it off.

Officer Kristopher John Bieger's pattern of conduct escalated during the years from excessive calling, texts and stalking. Did the department look away and not handle this as a serious crime because he was the son of a respected, retired cop? Is it possible that Officer Skinner was ignored by the department? Was she politely told "it is not in your best interest to make waves? How about a place outside of the department veil where Officer Skinner could have received assistance?

Is the Lauderhill Police Department unaware because "no official" record exists.? The statement by Police Captain Stanley "there are a lot of mixed emotions on both sides" incorrect response in my expert opinion. Officer Bieger emptied 10 rounds at Officer Skinner. The only reason she survived unharmed, Skinner was wearing her bullet proof vest. Afterwards, Officer Bieger fled the scene, followed by a stand-off for a couple hours outside a pizzeria until he surrendered to fellow officers.

This crime has nothing to do with whether officer Bieger was in his right mind at the time. The officer did not simply have a bad day and snap!

I hold law enforcement to a higher standard. I always have, despite the fact that I am a police officers daughter galvanized by a tragedy I would not wish on anyone. And not only do I respect law enforcement both on a professional and personal level, I expect those commissioned as sworn officers to know right from wrong when it relates to their personal relationships outside of the department. Extending and implementing policies at the State level on down to the rank and file within police departments.

What is the Lauderhill Police Department and others across the nation doing to prevent these types of intimate partner violence officer related crimes from escalating? Do they have training and continuing education in place? Is it effective?

Education and training has proven an effective solution within agencies of officer involved intimate partner and stalking crimes.

Diane Ward: A Master Manipulator Vs. Intimate Partner Homicide

On November 8, 2011 a sentencing hearing is scheduled for Bob Ward 63 yrs. old, a wealthy developer convicted of 2nd-Degree murder of his wife Diane, by a Florida jury last month.

Ward faces a 25 years to life sentence and given his age he will likely die in prison. There was a lot of nasty speculation and blaming taking place no doubt by supporters of a man who killed his wife of 25 years in cold blood. A common theme known as "victim bashing" repeated across the country in a number of intimate partner violence cases that result in homicide.

These individuals hold masters degrees in manipulation. Behind closed doors their training begins with emotional abuse by chipping away at the mental well-being of their victim. Once the skill is somewhat perfected they often practice on other members of their immediate family and close friends. The picture they paint is slanted. When they go out as a couple should anything appear or sound out of place the offender seizes the moment to make it appear as if she is crazy. Or they tell stories over a long period of time setting the foundation for "things" changing in the relationship.

A "man's-man" never expresses emotions or feelings that are often attributed to women. Real me don't break in public. So when the clever psychopath opens up (tissue please) to those around him it is taken seriously. Factor in the offenders occupation and work ethic followed by a few Glen Grant scotch's served neat while enjoying a Davidoff Gran Cru cigar and you have the perception of a pussycat not a lady killer. Let's not forget a wonderful attentive and caring father, friend and employer.

He makes remarks like "I don't know whats wrong with her." "You know she is drinking more and more each day." "I am afraid to come for fear of what I will find." "I am being attacked in my own home." "She is crazy and needs help. "All I want is to be happy. I work my ass to provide, ya know?"

In between all of this she the victim is isolated from once close friends, family and her own children." The children caught in the middle and if old enough will comment "Why are you so mean? Why are you making dad crazy?" Instead of identifying to what was already happening before they learned to walk.

Why would anyone throw their life away when they have it all? Why didn't Bob Ward walk away? Because it's never the hand of cards an abuser hold. Fold-em and walk away; translation failure to be a "man."

Unless the perception set-up months and perhaps years before that "she" drove him to the ultimate action that resulted in murder. And he could take comfort in being absolved or forgiven by those closet to him.

News Flash: No one drives anyone to pull a trigger and commit murder. The one who pulls the trigger has planned and plotted over a long period of time. Abusers are thieve's gathering in the thousands in our society, taking away the very lives of their wives and mothers of their own children. Behind closed doors where no one can witness their behavior and actions.

It is difficult to comprehend a parent capable of killing anyone when they are so attentive and loving to everyone else, but the victim. This is key to the thousands of intimate partner homicide cases we hear and read about as the victims voice is forever silenced.

On September 24, 2011 a jury listened and Diane Ward's voice was heard. The case weighed heavily on the 911 call where Bob Ward says 5 times "I just shot my wife."

The defense attorney commented after the verdict was read, throwing-out remarks regarding the Casey Anthony trial, implying the verdict was based on a vendetta of sorts as if to say the Orange County Florida jury was swayed over that case's outcome and his client paid for it.

Intimate Homicide is a crime. Whether or not anyone loved, liked or could have cared less that Diane Ward died. No one has the right to take a persons life.

Taking center stage, is but one man, whom with taxpayer money is allowed to live, Diane Ward will never have that opportunity!

Just because you are not physically hurt in your relationship does not mean you are free and clear. Emotional abuse can and does lead to intimate partner homicide. In many of the recent cases where women have gone missing and have yet to be found, they were never hit or beaten with fists. Instead, words, the same as you see above were their abusers weapons. When that no longer worked they went from words to action, silencing women and the mothers of their own children, forever.

You cannot fix or rescue these individuals. They are toxic and dangerous to any relationship.

Before you consider filing for a divorce or moving out, you better have a plan. He (the abuser) has one if you leave. And the last time I checked designer body bags were not considered a fashion statement.

Manhunt for Daniel Proctor: Homicide of Amy Patterson of Florida

There is a national manhunt underway for Daniel Proctor (pictured above) from the Lee County Sheriff' in Florida.

Amy Patterson, 41 pictured above with her estranged boyfriend, Daniel Proctor has not been seen since July 29, 2011. Amy was a teacher at Mariner Middle School in Cape Coral Florida.

When Daniel Proctor unexpectedly popped in for a visit to see his month in Alabama, arriving in Amy's vehicle. His mother asked where was Amy ? He told her she was in Texas. Something was amiss and when she called the school where Amy worked she learned no one had seen her in a month. She kicked her son out of the home. Then she called the Sheriff's office and made a report.

Daniel Proctor at one point when asked told police "Amy died in a car accident." It is because of that statement he made to law enforcement the case was changed from missing person to "domestic homicide." Now they are looking for him. I wish more departments were as on the ball and aggressive when a woman "suddenly vanishes." But it rarely happens that way. Very few law enforcement agencies have training in the area of intimate partner violence and homicide.

Daniel Proctor's statement that Amy died in a car accident is an announcement to the world that he killed her. He considered armed and dangerous.

Caylee Marie Anthony : Shining the Light for Justice

From the moment Caylee Marie Anthony's remains were discovered, her young voice silenced, the world stood up and took notice. This child would be recognized internationally in her tragic death and yet seemingly invisible during her short time while alive on earth. Caylee's bright eyes and smile captured our hearts.

As a homicide survivor, moving forward to direct others to safety, shinning a light on their path as it relates to victims of intimate partner violence and homicide was the best way to honor the murder of my own mother, Roberta Murphy, age 47, by my father a Chicago violent crimes detective in 1989. I learned everything I could about crimes within families, from spending long hours in courtrooms to directly helping loved ones at crime scenes and assisting them at surviving every moment of each new day.

Out of my work produced my first book, published by Doubleday books titled "Defending Our Lives: Getting away from Domestic Violence & Staying Safe" in 1996. From there "Moving Out Moving On," Time's Up: How to Survive Abuse & Stalking Relationships" and now the upcoming book scheduled to be released this fall "Holding My Hand Through Hell." Because of my mothers murder, thousands of women and children are less likely to end up from someone else's rage listed on a cemetery headstone.

The same applies to true Crime Author Diane Fanning, whom on November 3, 2009, released the only book on this precious child's life titled "Mommy's Little Girl."

She is an advocate for change. Her voice is often used for those who have been silenced or wrongly convicted. I am sure many of you do not know that earlier this year, Diane Fanning won "The Defenders of The Innocent Award" from The Innocence Project for her true crime book "Through The Window."

Through The Window is more than an investigation into a crime spree that stunned a nation. It's an utterly terrifying plunge into the unfathomable dark mind of a serial killer, and the heart-wrenching story of the brave child who finally brought him to justice.

Fanning's book in April of 2003, was responsible for Julie Rae receiving a new trial. Her conviction over turned because Fanning's book proved Julie Rea did not commit the crime.

With the same investigative tools and insight, Diane Fanning authors "Mommy's Little Girl." This is not just a book, but a voice for Caylee Marie Anthony. Written and released during a time while the world remained outraged and numb. The answers to her life and death are now forever preserved, not only in a book, but in a permanent record for future generations in the Library of Congress.

If we take tragedy and use it to change lives, each of us can hold the lantern of light and hope for others. Diane Fanning should be a shinning example to us all.
