Picture Perfect Former Officer Sentenced : 50 Years in Prison Murdering Husband

Last week a jury found former California Highway Patrol officer guilty in the murder of her husband Marcus Lavar Lemons.  A judge sentenced Tomiekia Johnson to 50 years in prison.  


In cases of intimate partner violence that leads to homicide a perfect picture as shown up on the couple's wedding day  is not always reality behind closed doors.  The killer was a trained law enforcement officer.  She used a defense during the trial that never passes the smell test in cases of spousal murder, "claiming the gun discharged accidentally."   Back on Feb 21,2009, the then officer claimed the couple pulled off the road during a heated argument she claimed that Marcus was both verbally and physically violent and the gun went off with him taking a bullet in the head.   Her story continued to change when questioned by investigators. Testimony included forensic evidence that she was not inside the car as originally claimed, but, outside of the car when she pulled the trigger.


The murder of Marcus Lavar Lemons was a premeditated crime by a sworn law enforcement officer who likely banked on the fact that she was a female and would likely get away with murder.  But the evidence against her during trial was overwhelming.  


And in any future appeal that the former officer attempts to file for a new trial will likely be denied.   The family of Marcus Lavar Lemons can thank Los Angeles Superior Court Judge Robert J. Perry in ensuring the killer has no basis or claim to appeal the verdict. 


Inmate partner homicide is not gender specific. Nor is a relationship as  perfect as the picture they want the world to see.  Both men and women are capable of killing the person with whom they are in a relationship.  It stings a bit more when a person sworn to serve and protect uses the law to brake the law to commit the crime of murder.

Supreme Court Grants New Trial to Former Police Chief

“Former County Prosecutor Jennifer Lowrie (smiling below) was the first person to arrive at the scene of the shooting which occurred at the Huber household Oct. 28, 2007. She admitted to law enforcement that night that she and the then Police Chief Ken Huber had been having an affair. She also said Pam Huber knew about the relationship.

Accidents with a firearm are common among cowards with badge's whom murder their wives in cold blood. Former Chief of Police Ken Huber, also a weapons expert and instructor at the time "his gun discharged" won the right to a new trial. Last week, the South Dakota Supreme Court ruled that during the murder trial of Pam Huber, the circuit court judge did not allow experts to testify Huber's gun "could have discharged by accident while he was attempting to secure a lock on the weapon." He claims it went off and struck his wife Pam Huber in the head.

The 2007, criminal complaint against Ken Huber showed that after dialing 911, he called the then County Prosecutor Jennifer Lowrie, whom admitted in the complaint to having had a sexual affair with Ken Huber. She arrived at the scene before law enforcement or EMS personnel, walked through the crime scene and was handed the phone to talk to the 911 operator, per the court documents.

Pam Huber (pictured above) died from her injuries on Friday November 2, 2007. She does not have the opportunity to file and appeal for a new trial. After the shooting a protection order alleged that former Miller and Highmore Police Chief Ken Huber walked into a bedroom where his wife and 11 year-old daughter were laying in bed and shot Pam Huber in the head.


Family attorney Matt Theophilus says, "He approached her in bed and shot her one time through the forehead, daughter unfortunately awoke to the sound of the gun shot and saw her mother terribly injured and bleeding and saw her father leaving the room with a gun in his hand."

In 2007, Matt Theophilus was the attorney representing the Huber's 11 and 12 year old daughters, and Pam Huber's son. The three filed a protection order against Ken Huber because he has not been arrested immediately following the shooting of their mother. Theophilus says, "Their concern is what will he do in the future." That concern comes because of what they say Ken Huber has done in the past. The protection order says Huber has physically and emotionally abused Pam Huber for at least 10 years, but she never reported it. Theophilus says, "She has never felt able to report this for fear of reprecussions given his positions as chief of police."

If Pam Huber had the opportunity, prior to her murder, to prepare a "Evidentiary Abuse Affidavit" and video as prescribed in the book "Time's Up," there would be no opportunity for the supreme court to grant a new trial. Pam's words and testimony, from her grave, would have been sufficient.

It is up to you and I to sound the sirens for justice to those married to law enforcement officers whom fight to the end, silenced by a system where the brotherhood of the badge continues to send innocent women to their graves.

Remembering Kathleen Savio a Casualty in the War of Officer Related Intimate Partner Homicide

Two young boys, ages nine and eleven, lost their loving mother Kathleen Savio on March 1, 2004. Her death was an accident, they were told. Seven years ago today, in my opinion, she was murdered.

Never again will their mother greet the boys in the morning when they wake. In the afternoon when they return home from school, Mom will not be waiting for her boys. She will never again ask either of her sons "How was your day at school?" She will not be in the kitchen preparing dinner while they do their homework.

And Mom will no longer kiss them on the cheek, wishing each of her boys sweet dreams, as she had done thousands of nights.

I realize the photo's from the crime scene when Kathleen Savio's body was found will never be released and kept under seal from the public. For three reasons:

1st-If you saw these particular photo's you would know by viewing them that she was beaten. Brusises covered her back, torso, arms, shoulders, stomach and legs. From the naked eye there was no doubt this was not an accident, Kathleen Savio was murdered.

2nd- The way her body was positioned in the tub is something commonly taught at the police academy, dipicting a staged crime scene.

3rd-Those investigators who looked away by not documenting her murder, thinking they were doing their fellow buddy in blue a favor, caused the killing of yet another innocent victim of war Stacy Peterson.

I for one would like the names of these so called investigators along with former State's Attorney Tomczak to be gathered together for a formal Senate investigation hearing for the "war on intimate partner homicide." I realize it will do nothing to give Stacy Peterson, who vanished on October 28, 2007 and is still a missing person. or Kathleen Savio whom Peterson is now awaiting trial for her murder back their lives. But it will do so much to prevent future casualities in this war. Peterson is a social and psychotic nightmare of the worst kind, and we can learn a great deal in talking, reviewing, analyzing and finally implementing procedures many on the book "Time's Up," proven to be effective saving lives while addressing what has and hasn't happened since the murders of these two women.

If law enforcement and the legal system had done their jobs back in 2002, when Kathleen Savio asked for help, perhaps she would still be alive today. At the very minimum had those on the crime scene conducted their investigation properly, Drew Peterson would have been arrested for her murder.

We mark the anniversary of her death as a way to sound the sirens for justice to those married to law enforcement officers whom fight to the end, silenced by a system where the brotherhood of the badge continues to send innocent women to their graves.

Kathleen Savio deserved so much more, may she rest in peace.

One day the legal system will embrace the messenger utilizing proven strategies and implement the prescription for change that will enforce the laws while at the same reducing the number of murders without anyone's ego getting bruised. A Special Place in Hell For Killer With A Badge?







A cop whom according to reports and former officers working along side of him "should have been stripped of his commission as a law enforcement" officer long ago. A departments rank and file that looked the way over an anrgry and controlling cop on Friday evening cost two people and possibly a third their lives.

Charlotte Grahn filed for divorce in August of 2009. She was afraid of her husband a Clackamas County, Oregon deputy sheriff. Charlotte believed if she pressed charges for the beatings he would get fired from his job. And that would only make Jeffrey Grahn more violent. But others knew like Sheriff Craig Roberts and on a private site for law enforcement someone in the know commented:

"Unfortunately the guy had been unstable for quite a while and the Boss chose to ignore it. This is not a surprise for those who had to work with Grahn.

When you're married, have kids, choose to get a girlfriend in the courthouse, that ends up getting you moved from the courthouse to graveyard patrol. When you suck as a Patrol Sgt. because none of the troops trust you, then you divorce your wife, but can't control her afterwards..... God speed Charlotte, you were an angel to put up with him.
Grahn...rot in hell!!"


Another law enforcement officer on site said:
"Suffice it to say that for those of us that had to work with this SOB, this was no surprise. Ask yourself why senior guy's who could hold day shift for the rest of their careers would bid off to nights when Grahn bid days?"

Charlotte was out for the evening with two of her girlfriends and a local establishment in town. Jeffrey Grahn walked in and the couple began to have a heated discussion. She went outside to get away from him. He shot her in the parking lot. Then this piece of grabage went back inside and shot the pther two women and the table. Kathleen Hoffmeister died instantly and Victoria Schulmerich is in critical condition fighting for her life. After shooting all three women Jeffrey Grahn committed suicide.

Now, three children are orphans because a small town refused to see that Jeffrey Grahn had no buisiness as a sworn law enforcement officer. They all knew that this guy was trouble. They all knew he was dangerous and yet his remained in a position of authority. Grahn could not deal with the fact that his wife was no longer under his private lock and key.

Because the police department and the union looked away they need to be held accountable. The Grahn children and the surviving families of the two victims shot likely have a lawsuit to file in the near future. The Attorney General John Kroger office needs to hire a special task force and make approppriate command changes within this depatrtment. A state-wide protocol should be considered and implemented for officers going through divorce. As in this tragic case the rank and file including the employee's within the department must be held accountable.

No one was willing to take action and come forward when Grahn started exhibiting strange behavior.

On Friday, February 12, 2oo9, the brotherhood of the badge kept it's code of silence and innocent lives were hijacked all in the name of shear ignorance.

"Murder Behind The Badge"


As a former police officers daughter, I know firsthand the fear and trauma associated in living with a man that used his badge, ultimately committing murder. In the 5th grade our class was given an assignment to write a poem about our lives. I wrote:

This man who drinks and carries a gun, each night he’d come home it would be no fun.

That badge, that gun, we have no place to run.

In my 20 years advocating police perpetrated homicide the horrors of living with a violent abusive police officer, those committing unspeakable acts of murder were, until now, silently buried with the victims.

Finally, Author and former detective and Women In Crime Ink Contributor Stacy Dittrich has written Murder Behind the Badge profiling police officers who kill for love and money, to the ones who kill over simple personnel complaints; included among other are the stories of Drew Peterson, Bobby Cutts, Ken Dekleine, Richard DiGuglielmo, and Lawrencia Bambenek.
These are stories of the men and women who abused their power, took human life, and will forever pay the consequence.

Justice Interrupted in Officer's Wife's Death


Tera Chavez

When the news story first came out it stated Tera Chavez had committed suicide. What those who were involved in this cover-up did not know, Tera had been in contact with State of Arizona Invetigators.

In a bold move, Tera's death was ruled a homicide. Lawwyers for the family hired attorney Brad Hall and filed a lawsuit against the police department for tampering with a crime scene, destroying evidence and interfering with another departments investigation out of their jurisdiction.

Officer Friendly in a Not So Friendly Way

During the first half of June Officers listed below have been arrested for crimes related to their own personal family violence. Over at http://www.behindthebluewall.blogspot the site brings awareness to an issue that remains behind closed doors. For a police officers family, wives and children, they have no place to turn for assistance from a system that slaps the offender on hand who also happens to be in law enforcement, these are just a handful of the thousands across the country that are swept under the rug and never get reported.


RI] Sgt Ciresi, accused of wife assault, sent to prison on other crimes ...he allegedly slapped his former wife, Lisa Ciresi, at her parent's house at 36 Spicer St. during an altercation over the impending sale of their house on South Locust Avenue..____________________________

[CT] Judge Strackbein doesn't protect Officer Knight's son & assures cop this can be resolved ...Knight claimed he only restrained his son to avoid an accident while driving home and "wrapped his son up" at the house in self-defense... Knight told police he was disciplining his son - "acting in a parental intervention role." Judge Hillary Strackbein told Knight that after meeting with family relations officials and avoiding any further incidents, "things should work out"...
