As a practicing clinical psychologist specializing in couples therapy, she is an Advanced Clinician in Imago Relationship Therapy and serves as an Academic Faculty Member of Imago Relationships International, the professional training organization for Imago Therapy. Having served since 1996 as Editor/Managing Editor of the Journal of Imago Relationship Therapy, she has published five books and produced numerous articles and presentations on topics related to relational psychology.
With Joe Marrone, Ph.D., she is the author of The EQ (Social-Emotional Intelligence) Program, which teaches elementary aged children the principles and practices of good character and of equitable and respectful relationships. Introducing Simply the Best : "Document the Abuse"


Today, we announce our new site www.documenttheabuse.com.  A place for prosecutors, law enforcement, social service agencies, human resource managers, workplace violence security experts, insurance carrier's, health care providers, faith based organizations and those directly in the process of divorce, affected by domestic violence and stalking by someone with whom they are in a relationship.

If you are in law enforcement the information and training provided on the Evidentiary Abuse Affidavit is a supportive component in addition to what you already are doing on the job as it is valuable tool that is saving lives.  For the first time when a potential victim prepares the "EAA" you will know and have at your fingertips information that includes the offender.  As are aware this is very important when a person in your district is reported missing or becomes a fatality.  You will have the victims words in a notarized, witnessed and taped statement already in your hand ready to meet with the prosecutor or district attorney for a solid case.

For those who enter the courthouses assigned to work the domestic violence and trial calenders the "EAA" has a number of benefits for a successful prosecution.  This includes cases where you have no body, but you do have enough evidence. Or in cases where the alleged defendant at pretrial claims crime of passion, unhinged, accident or self-defense, if the victim prepared the Evidentiary Abuse Affidavit prior to their death, its game on as a prosecutor for a winning victory and game over for the defense in court.


Case concerning the right to confront and prove intent to prevent the witness from testifying
Giles v. California, 554 U.S. 353 (2008)
Facts of the Case
When Dwayne Giles was tried in state court for the murder of his ex- girlfriend, he claimed self-defense. Giles stated that he had heard her vow to hurt him and a friend, and that she had previously shot a man and threatened people with knives. The prosecution then introduced evidence of a conversation between Giles' ex-girlfriend and police in which she claimed that he had assaulted her and threatened to kill her. The district court eventually convicted Giles of murder.
On appeal, Giles argued that use of the police conversation violated his Sixth Amendment right to confront witnesses against him, namely, his deceased ex- girlfriend.
The California Supreme Court held that Giles had waived this right because he was the cause of his ex-girlfriend's absence. Although this exclusion was justified under common law rules of "forfeiture by wrongdoing", the Supreme Court had greatly constrained the admissibility of such evidence in its 2004 holding in Crawford v. Washington. Crawford essentially wiped out the admissibility of such out-of-court statements unless the testimony could be subject to cross-examination at trial, an option that would be impossible under these circumstances. This case gives the Court an opportunity to expand on its decision in Crawford and to apply it to a situation where the wrongdoing that kept the witness from appearing in court was not motivated by a desire to prevent the witness' testimony.
Question
Are a criminal defendant's rights under the Confrontation Clause of the Sixth Amendment violated when the common law "forfeiture by wrongdoing" doctrine is applied to allow out-of-court statements made by a witness, absent due to the defendant's own conduct, into evidence without giving defendant an opportunity to cross-examine the absent witness?
Conclusion
Yes. In a 6-3 decision, the Court held that the forfeiture by wrongdoing exception only applies to situations where the defendant causes the witness' absence with the intention of preventing that witness from testifying at trial. Without this intention, any act by the defendant making the witness unavailable does not waive that defendant's Sixth Amendment right to confront and cross-examine the witness, and therefore any out-of-court statements made by the witness are inadmissible as evidence. Justice Antonin Scalia delivered the opinion of the Court.
Justice Clarence Thomas wrote a concurring opinion stressing his belief that statements such as those made by the witness in this case should not implicate the Confrontation Clause at all because the police questioning was not a "formalized dialogue." Justice Samuel Alito also wrote a concurring opinion suggesting that the witness' statements, in his view, did not fall within the Confrontation Clause but noting that neither party had made this argument before the Court. Justice David Souter, joined by Justice Ruth Bader Ginsburg, concurred in all parts of the majority opinion except one section denouncing the dissenting argument. Justice Souter stated that he did not find the dissent as wrongheaded as the majority suggested.
The dissentwritten by Justice Stephen Breyer and joined by Justices John Paul Stevens and Anthony Kennedy, argued that a defendant loses his right to confrontation when he makes a witness unavailable due to his own wrongdoing, even if he did not act with the specific intention of preventing her from testifying at trial.

Missing Person's case of Vernon Cameron Jones: More Questions Then Answers

"Vernon Cameron Jones, an aspiring actor who moved to Manhattan after graduating from the University of North Carolina, mysteriously disappeared nearly two decades ago. To this day, detectives, private investigators and his family search desperately for lingering clues that might lead to Vernon’s recovery."

Yesterday, on the Roth Show, along with Management Resources LTD of New York , a private investigation firm headed up by retired police Lt. Robert Rahn, we discussed the missing person's case of Vernon Cameron Jones and a family whom continues to seek the truth.

We learned the story told by the 3 individuals with Vernon on the night of January 2, 1993, was a fabricated tale told out of fear. After 18 long years, the trio continues to tell the same story. Chances are someone outside the group of these three may hold the key to where his remains can be located. Foul Ball in the case of Rebecca Lynn Simmons


On May 8, 2011, Rebecca Lynn Simmons vanished. A report was not generated on the 45 year old missing woman missing until May 31st. Although she had a colorful past of drugs and arrests, Rebecca was still a missing person.

It was not enough for law enforcement in South Carolina to do much of anything. When she vanished from a Walmart parking lot on the May 8, she had no cell phone, keys or money with her.

Immediately dismissed and labeled because of her past, a crime of the worst kind was committed by the law enforcement agency in which a report was finally, generated.

"...investigators say they don't believe foul play is involved or that she is in any danger. Please know I realize you and your family are still concerned about her well being. Because she is an adult and investigators don't believe she is in harms way (at this time) there's nothing I can do story wise." (June 30, 2011)

On July 13, the first news report surfaced that Rebecca was missing. Oh and did I mention that Rebecca Simmons had told her family (considered hearsay of course) that if anything ever happened to her that they need to tell authorities to go and search the well on "Hurricane road off Liberty highway." Rebecca was in a very abusive and dangerous relationship at the time she vanished. But the deaf and dumb process of checking out the information entered in the picture. Law enforcement could not be bothered. Again, this was someone who was not important in the eyes of society and law enforcement. Foul Ball!

Finally on July 15, after continued persistence by the family, law enforcement moseyed on out to the well. You know where the family said she would be all along. Guess What? When police checked the well at the bottom of the 50 foot drop, it was Rebecca Lynn Simmons.

It will be several weeks after toxicology reports come back from the lab to determine her cause of death. My question is if it is determined she was murdered, will there be an investigation? Or will the death certificate be stamped "undetermined" as the cause of death so that money is not wasted out of the tax payer budget for someone who choose to use drugs and was an addict?

In the story that appeared after her body was discovered, a reporter from Anderson, South Carolina wrote about the tragedy in a manner I frankly found offensive. Instead of perhaps offering hope to victims of possible intimate partner violence that could lead to homicide and ways in which to get help, the news coverage talks about her criminal past. A real slap in the face for all families of missing persons. Forget the fact that Rebecca was finally found. Forget the fact that law enforcement turned their heads. Forget the fact that she was a victim of an abusive relationship. Forget the fact that she did not deserve to die. Forget the fact that the person who was the last known person should be considered a suspect or at the very least a person of interest by law enforcement.

Forget the facts and justice in this case will never see the inside of a court of law!!

After my mother was murdered in 1989, by my father a Chicago violent crimes detective, I looked at what worked and what did not as it related to violence in the home. Spending 18 years on a perpetual crime scene allowed me to cultivate strategies and techniques that worked to keep victims alive. Through the years more victims of intimate partner violence simply went missing. Cleverly erased by a boyfriend or husband who played a masterful game with law enforcement and prosecutors of "catch me if you can." Between the murders and those who go missing not much in the way of assistance for victims was in place. Until, now.

Created because of women like my mother Roberta Murphy, or Stacy Peterson who went missing on October 28, 2007, without a trace is the book, or the safety "prescription" as it is called Time's Up: Guide on How to Leave Abusive and Stalking Relationships"

The guide is a life raft providing structure in the midst of chaos and it has kept many victims of intimate partner violence, to date, alive.

Among the tools and forms, is the procedure of an “Evidentiary Abuse Affidavit”, a sworn statement detailing the facts of an individual’s victimization, preserving the specifics so they are not lost even if the victim is reported missing. It is difficult to think about speaking from the grave, but no different than any life insurance policy obtained in consideration for those left behind.

An “Evidentiary Abuse Affidavit" and video has the additional psychological benefit of being forced to face reality and admit that the potential for the ultimate kind of violence exists…and that if it occurs the perpetratorwill be held accountable.

Domestic violence or intimate partner victims now are able to provide information, in their own words, about the fears, dangers, experiences they have had at the hands of their abuser. The" Evidentiary Abuse Affidavit" or "EAA" records victim's stories, histories, and experiences which are preserved and stored on their behalf. These videos will provide answers to the many questions, allegations, and fears that arise when a person has disappeared, gone missing, or been found dead.

Recent cases, such as missing mother Susan Powell of Utah, Kelly Rothwell of Florida, and women like StacyPeterson, where the victim’s police officer husband is the person of interest, is the classic example of the benefits of this type of evidence. If Stacy Peterson, or any woman found murdered or is missing, had done an Evidentiary Abuse Affidavit, ON TAPE, from following the information in the “Time’s Up" book on a flash drive, they would be able to describe:
- threats made against her life or wellbeing, including details of how the perpetrator would carry out the threat
- incidents of past abuse that the victim has endured
- admissions or comments made to her about other victims or people abused
- where evidence or weapons would or could be located
- possible alibis that the perpetrator would make up in his defense (including identification of people who could be co-defendant’s or co-suspects)
- portray visible injuries or marks
Just think if we incorporate an effective plan and have it available for every prosecutor, law enforcement, church, family law office and social service agency across the country, lives would be saved. And I wouldn't be writing about women similar to Kathy Brados, killed by a man hell bent on power and control.

Krishonda Leanne Townsend: A Crime Continues in Silence

In the town of Mineral Wells, Texas, a tragic reminder clouds the town like a blanket over this 4th of July holiday weekend; one of their own is still missing. Those who know the truth continue to hide, hoping no one talks or comes forward with the truth of really what happened one year ago.

On July 4th, 2010, Krishonda Townsend, 19, went missing. She was not abducted by some stranger. She did not leave of her own free will. She did not drive her car to a location in a part of town deemed unsafe. She was abruptly taken and never seen or heard from again.

With over 1,100 comments on a blog written about Krishona earlier in the year, one would hope that instead of leaving clues, poems and finger pointing, they would find a way to come forward with what they know, either by contacting authorities or leaving a tip with the CUE Center for Missing Persons.

As a full year passes, the crime of silence will continue to live and breathe in the community of Mineral Wells. I wouldn't want to remain in a place where the person I stand next to while watching the fireworks this year along with my kids, is responsible for Krishonda's disappearance. In not demanding answers in your community, supporting this family, passing posters out or holding town meetings until she is found, you invite the person who took this young teenager and mother to strike again. If they got away with it once, it is likely someone else will pay the same high price with their life.

Just think if a fraction of the planning by the town of Mineral Wells went into finding Krishonda as it has in scheduling a day of festivities with food and fireworks, she would have an opportunity at being found.

Details of the case: 
Shonda Townsend White female 19 years of age . She is 5 ft. 3 in. tall and weighs between 115 and 120 pounds. She has brown eyes and blonde hair with a pink streak. Allthough her natural hair color is a light brown. She has braces with pink rubber bands. She was last seen in Mineral Wells on the evening of July 4 th. 2010 . Between 11:30 and 11:40 p.m. From a residence in Mineral Wells. She was wearing a black tank top trimmed in white, pink shorts, flip flops and a black two piece swim suit with pink and white polka dots underneath. Shonda left the residence driving a 1997 gray/blue Toyota Camry. At 12:10 am Monday , Shonda text her mother stating- On my way home. And no one has heard or seen her since.

Public and private rewards are offered for information leading to discovery of Townsend and anyone responsible for her disappearance resulting in an arrest and grand jury indictment.

Deadly Silence and Intimate Partner Relationships

There are far too many cases when a woman suddenly vanishes without trace because of intimate partner violence in their marriage or relationship. The husband or boyfriend in the current or former relationship is angry it is ending. A victim prepares to leave is filing or already has filed for a divorce. The woman often tells a close friend or family members "if something happens to me" tell the authorities it was "him."

That is called hearsay and it will not hold up should a person "suddenly vanish"as anything other than repeating something second hand. Those possibly responsible quickly become silent and uncooperative with authorities. In many cases they quickly lawyer up. Stopping the epidemic is the key to holding accountable one of our nation's most deadly crimes: Intimate Partner Violence and Stalking that leads to homicide.

Before anyone says they are ending the relationship; they must complete the abuse affidavit and video as exampled below:

Gail Nowacki Palmgren: Beyond the Mountain Top


Dr. Gail Palmgren age 44, mother of 2 vanished from Signal Mountain TN, on April 30, 2011. Weeks before she was in the process of ending her marriage. Gail does what I have instructed victims of intimate partner violence to do for over twenty years, tell a trusted friend.

Gail Palmgren confides in Arlene Durham, her best friend. She gives her various items, paperwork to hold for safekeeping, keys to property, along with her verbal and email instructions to pick up a dvr at best buy. Because of various spyware applications on cell and her own personal computer Gail is unable to facilitate certain safety plans as it relates to leaving. Her best friend, Arlene gives Gail her laptop to use.

At the urging by Gail's relatives and Arlene, Matt Palmgren reports his wife missing. Arlene gathers everything given to her by Gail and goes to the police making every effort to tell them what she knows and hand everything over. The police response was dismissive. Signal Mountain Law Enforcement decide to turn a deaf ear.

How many of missing persons cases's involving women and mothers in the process of ending their dysfunctional and often violent relationship have to go missing before it is taken seriously by law enforcement?

The case is now 56 days-cold! Many a missed opportunity, erased by, in my opinion, incompetence in this particular missing persons case. Arlene Durham's only "agenda" is finding her best, Gail. She has important information in this case that I believe is of significance to what happened to Gail Palmgren. Speaking from experience, no one listened to my mother, or all those thousands, like her who go missing each day. The crime of intimate partner violence that leads to homicide is still dealt with in silence behind closed doors. I am one of the lucky ones to have been able to find my mother after searching for three days and take her to what resulted in a final resting place.

I vowed the day my own father murdered her that I would not allow another woman to be a statistic. Arlene Durham is doing the same as she shouts from beyond the mountain top for help in finding her best friend, Gail. That cry for help now includes the media.

Earlier today, on the show "Times Up" Arlene Durham was a guest on the live broadcast along with Robert H. Rarn, Retired Lt and Kim Anklin Criminal Analyst, principals in the firm Management Resources, Ltd., we discussed the missing person case of Dr. Gail Nowacki Palmgren.

The only goal is to find Gail Palmgren. If you or I were to go missing, I hope my best friend would do exactly what Arlene Durham is doing, shouting from beyond the mountain top, until we are found!

Description of Gail’s Jeep

Gail drove a four-door maroon 2010 Rubicon Jeep Wrangler with a black soft top. The wheel cover on the back has the words “Life is Good” and a daisy painted on it. The trailer hitch has a picture of the Disney character Goofy on it, and the Jeep has Alabama tags that read “EAZY ST”.

Gail is 5’8” and weighs 135 pounds. She has blonde hair and brown eyes.
