A Letter to the Parents of David Hartley and the Media

When David Hartley was reportedly killed the tragic story of what supposedly happened on the lake that afternoon was told to the world by the last person to see David Hartley alive.

There are too many unanswered question about your son's death.  And after the holidays it is my hope that you the parents, perhaps with the direction of others in your community will seek answers and fight for the truth.  You owe it to your son, David.

The information below was released to the public 4 months before your son was killed. It is important to notice that the same story given by the sole survivor is similar as to the information released by authorities regarding the area.  They scared people on the lake and took money. They did not kill them.  Where people robbed took "photo's" is the same place the only survivor says they also went.  In the 911 call it was stressed what side of the water the tragic event took place.  Again, impossible.

It is very difficult to believe the person with whom we have come to know or take into our family is capable of causing harm.  I work on these types of cases everyday.  I have nothing to gain by pointing fingers or accusing anyone of any crime it serves no purpose. I work and am successful in saving lives, but learn from those who are silenced by those who profess to love them.

To the David's parent's the events of September 30, 2010, as told, are impossible.

On May 17, 2010 -Law enforcement agencies urging caution on Falcon Lake

Citing several armed robberies and attempted armed robberies on Falcon Lake in Zapata County, the Texas Department of Public Safety, the Texas Parks & Wildlife Department and the Zapata County Sheriff’s Office are strongly urging boaters on Falcon Lake to stay on the United States side of the lake and not venture into Mexican waters.  http://www.txdps.state.tx.us/director_staff/public_information/pr051810.pdf

Three reported incidents since " April 30" have raised concern among law enforcement officers in the Lake Falcon area. Two of the three incidents involved United States citizens who had gone into the Mexican side of the lake, passing the International Waters markers. Most of the incidents occurred in the Old Guerrero area, but it’s possible that other areas are a concern as well. Fishermen are advised to stay as far away as possible from any of the Argos-type fishing boats typically used as fishing vessels by Mexican fishermen. These boats have a large prow, a small outboard motor without a cowling and no identification numbers on the hull.Several bass fishing tournaments are scheduled for Falcon Lake during the next few weeks, and officials are concerned that they could be in danger if they cross into Mexican waters while they fish. One of the incidents occurred in U.S. waters. This weekend, Zapata County Sheriff Sigi Gonzalez, will discuss these concerns with bass tournament participants. He has been working with Texas Parks and Wildlife regarding security matters on Falcon Lake. The DPS Border Security Operations Center and the Fusion Center are working with Zapata County and Parks and Wildlife to review protective measures in the area.

The robbers are believed to be members of a drug trafficking organization or members of an enforcer group linked to a drug trafficking organization who are heavily armed and using AK-47s or AR-15 rifles to threaten their victims. They appear to be using local Mexican fishermen to operate the boats to get close to American fishermen.

• On April 30, five people in two different boats were fishing on Falcon Lake and went to the Old Guerrero area, where they were taking photos of the old church. While they were there, a boat with four heavily tattooed men approached the two boats quickly. The men identified themselves as “Federales,” but they were not wearing uniforms. The men boarded the boats, demanded cash and asked “where are the drugs?” The fishermen told the men that they had no drugs and were just fishing and taking photos. They ended up giving the men $200 cash-  www.txdps.state.tx.us

To the media I am asking that you assist the parents of David Hartley, it is the least you can do since providing a national platform from the only "witness" without checking details and facts.  And as you each understand the "devil is always in the details."    The world was given a story based on events similar to those on Falcon lake in prior months.  Obviously if this area was "so dangerous" why would there be a bass tournament?  Why not cancel the event it if it was going to cost lives?  Because there was no real danger only what was sensationalized in my opinion after the death of David Hartley.   In these types of cases they are called intimate partner homicides. This is where a spouse either a man or a woman related to the person missing or killed used other events in their story telling as they hope the person will never been found and if they are the truth of what really happened can not come back to them.  David Hartley's case can in my opinion be solved not by finger pointing, but with the facts and evidence. That is what myself and others provide to families and law enforcement.

The longer time passes the more difficult it will be to solve the case.  I am asking that you consider my words from someone who knows first hand these cases.  Although when my own mother was murdered in 1989, I was fortunate that her body was discovered within a few days.  And it was soon after I trained to work in this specialized area providing a balance for truth and justice in crimes involving the last person to see their spouse alive.

Finally, and more importantly, where is the body of David Hartley?

The 911 call Tiffany Hartley made on September 30, 2010 reporting her husband was shot by pirates, does not pass the "float test."  The devil is in the details regarding the vanishing of David Hartley.

"The shoulder shrugs, lip licking, like um and ums, monotone,  verbal inconsistencies in her story and choice of words make me question what really happened to her husband.
In her  911 call, she is asked if she is sure her husband has been shot, She said “yes in his head” .But she doesn’t go on to elaborate about him- the alleged victim. She doesn’t say that  he was bleeding or incapacitated, which would happen if someone was in the head. Instead, she provides herself with an excuse or an alibi for his non survival and for her actions  by saying she is too weak to pull his body unto her Jet Ski. She was forced to abandon him there. "

Tiffany Hartley: A Call To Action: Part 2

On part one here yesterday, we challenged the media to ask some important questions including treating this woman, Tiffany Young-Hartley as at the very least a person of interest.

We have been encouraged by the responses to a call to action thus far, and encourage any journalist who treasures the word "investigative" with their title, to respond.

Levi Page is one such journalist who has committed himself to justice; though not always in step with popular media hosts, he has refused to turn a deaf ear to the obvious and join in calling Tiffany Hartley "courageous" or a "voice" for America. He will continue to cover the case, also seeking justice for David Hartley and his family, on The Levi Page Show on BlogTalk Radio.

Journalists, with dogged determination, can dig and dig until the truth, no matter what it is, is uncovered.

But what of law enforcement?
If a man drove up on a jet ski and called 911 to report that his wife had been gunned down by Mexican "pirates", and he told a tale where he portrayed himself as a hero, even in the face of an onslaught of bullets hailing all around him, but finally, reluctantly, and with the voice of God, was forced to abandon his wife, would a sheriff have simply taken his word for it?

Had he said, "don't bother to search, my wife's on the Mexican side", would law enforcement simply said, "ok, case closed"?

Would Sheriff Gonzalez take one look at him, untouched by bullets (and without a single nick on his jet ski) and said, "I can tell he is an honest man. No need for a polygraph."?

What if he said that ruthless drug cartels "decided" after killing his wife, to just let him go? Would that not raise an eyebrow or two?

How about afterwards: let's say this same man, a day or two later, contacted media and went from talk show to talk show: Would his words matter to you?

What if he announced that his wife was the love of his life, but it was time to move on?

What if he said he knew his wife would have wanted him to see the world, do some serious Black Friday shopping, and "live the life" a month after her murder?

Sheriff Gonzalez, would you feel a bit queasy on this one?What if the same man declined any call for justice for his slain wife, but only wanted her body back.

Would you still be able to retain the respect of your deputies even after ignoring this blaring red flag and all the others?

Sheriff Gonzalez, it is time to think about your actions.

What did Gonzalez have to gain by taking Tiffany's word that her husband's body is on the "Mexico" side; even though they were racing as fast as the jet ski could take them (60mph?) towards home? Was there a sort of marker in the water in which Tiffany could see the demarcation? Would any law enforcement personnel in the country just take a person's word for it, without verification?


For law enforcement here is what must be investigated.


There is an insurance policy within the company David Hartley was employed.

Law enforcement 101: check with human resource people within CalFrac Well Services to see if she inquired as to what they need for a pay-out. Go back 6 months and ask some questions.

And it might also include a double indemnity clause as an insurance benefit provision or addendum. Tiffany Hartley likely is the sole beneficiary. This information is not public record and must be obtained from the company in which he was employed. It is easy enough to get: investigative subpoena will do the trick. Separately check also with the policy holder directly for any communication prior to David Hartley vanishing.


Cell phone records: both those of David and Tiffany Hartley. She also likely used his phone at different times. Also check on the computer activity used from the cell phone and go back as far as 9 months of activity. It is likely you will not see much activity 30 days before David vanished; but go back a bit further. This was not random, but showed planning and alibi building at least a month earlier,likely many months.

Next: Cell phone usage after David vanished.

If his cell phone was in the truck that day and it was a company phone was it returned to the company was it used? Cell tower activity on all phones especially 4 weeks prior to the date she left the area. Current cell phone activity should be investigated.

We still haven't left Investigation 101.

Journalists, are you listening?

Ever hear of the Freedom of Information Act?

Do you want to hear the complete 911 call? Did Tiffany have you at "hello", even though you have read the FBI's own litmus test for guilty homicide callers? Do you still wish to refer to her as "cute"?

Obtain computer activity from David’s computer and Tiffany’s computer. Subpoena email activity records from the Internet carrier. Search for records must include google map activity and skype connect calls (that is often missed in intimate partner crimes.)

Tiffany was employed, but where? Check her computer activity at her place of employment. Also if there is a library where the couple lived or Internet access at a local cafe it should be checked.
David Ramsey- Tiffany sought the assistant of radio and financial expert Dave Ramsey and she met him in person. Also Tiffany thanked Dave Ramsey for his advice. The couple was obviously lived past their means if they went to Dave Ramsey. I would investigate if the jet skis were owned free and clear or did they owe money on them. In an interview, ask Tiffany to explain what "the life" means to her?

You may be surprised at just how much she reveals.

Obtain the registration of both jet skis and put out an alert for the missing skis.

How about a reward?

Investigate which jet skis Tiffany actually has, hers or David’s. Place a stolen warrant in the system for the missing jet skis it is likely it could turn up. Place the warrant for the skis in both Mexico and the United States. The one Tiffany returned to tell her story was indeed registered to David M. Hartley (this information was obtained from the police stop earlier on the video dash cam as it showed the back of the trailer where they were transporting skis.)

Investigate friends of Tiffany Hartley at her work and David’s in the area or other wives whose husbands worked for CalFrac Well Services. I would check both English and non English employees spouses. If she spoke Spanish fluently Tiffany may have kept that quiet.

Investigate any Western Union activity within 60 days of David vanishing. Unusual charges to credit cards both she and David Hartley’s. Federal express records of ingoing and outgoing packages need to be reviewed through the time she left, especially in Mexico.

This is not complicated. It is long, boring arduous work.

It is also something that investigators love.

Why?

Because it is often the tiny, overlooked detail that brings out the truth.

Had a man emerged from Falcon Lake sans wife claiming to have been in a hail of bullets with not a single one of them hitting him or his jet ski, yet scoring a perfect head shot on his wife,

would law enforcement and media turned a deaf ear, and a blind eye, to justice for the missing? 

It is time.

In part 3, if more journalists will not step up and law enforcement will continue to shrug their collective shoulders, then it shall be time for the public to take some action.
