Supreme Court Grants New Trial to Former Police Chief

“Former County Prosecutor Jennifer Lowrie (smiling below) was the first person to arrive at the scene of the shooting which occurred at the Huber household Oct. 28, 2007. She admitted to law enforcement that night that she and the then Police Chief Ken Huber had been having an affair. She also said Pam Huber knew about the relationship.”

Accidents with a firearm are common among cowards with badge's whom murder their wives in cold blood. Former Chief of Police Ken Huber, also a weapons expert and instructor at the time "his gun discharged" won the right to a new trial. Last week, the South Dakota Supreme Court ruled that during the murder trial of Pam Huber, the circuit court judge did not allow experts to testify Huber's gun "could have discharged by accident while he was attempting to secure a lock on the weapon." He claims it went off and struck his wife Pam Huber in the head.

The 2007, criminal complaint against Ken Huber showed that after dialing 911, he called the then County Prosecutor Jennifer Lowrie, whom admitted in the complaint to having had a sexual affair with Ken Huber. She arrived at the scene before law enforcement or EMS personnel, walked through the crime scene and was handed the phone to talk to the 911 operator, per the court documents.

Pam Huber (pictured above) died from her injuries on Friday November 2, 2007. She does not have the opportunity to file and appeal for a new trial. After the shooting a protection order alleged that former Miller and Highmore Police Chief Ken Huber walked into a bedroom where his wife and 11 year-old daughter were laying in bed and shot Pam Huber in the head.

Family attorney Matt Theophilus says, "He approached her in bed and shot her one time through the forehead, daughter unfortunately awoke to the sound of the gun shot and saw her mother terribly injured and bleeding and saw her father leaving the room with a gun in his hand."

In 2007, Matt Theophilus was the attorney representing the Huber's 11 and 12 year old daughters, and Pam Huber's son. The three filed a protection order against Ken Huber because he has not been arrested immediately following the shooting of their mother. Theophilus says, "Their concern is what will he do in the future." That concern comes because of what they say Ken Huber has done in the past. The protection order says Huber has physically and emotionally abused Pam Huber for at least 10 years, but she never reported it. Theophilus says, "She has never felt able to report this for fear of reprecussions given his positions as chief of police."

If Pam Huber had the opportunity, prior to her murder, to prepare a "Evidentiary Abuse Affidavit" and video as prescribed in the book "Time's Up," there would be no opportunity for the supreme court to grant a new trial. Pam's words and testimony, from her grave, would have been sufficient.

It is up to you and I to sound the sirens for justice to those married to law enforcement officers whom fight to the end, silenced by a system where the brotherhood of the badge continues to send innocent women to their graves.

Theresa Parker: Can Finally Go Home

Theresa Parker, a 911 dispatcher with the Walker County Sheriff’s office in Atlanta, vanished without a trace in March of 2007. She was going through a divorce with her estranged husband Sgt. Sam Parker, a Police Officer in Lafayette.

Sam claimed as so many whom commit intimate partner homicide,” he had nothing to do with her disappearance.” And they she “ran away to start a new life.”

In September 2009, a jury found Sam Parker guilty of malice murder after a three week trial, even though Theresa's body had never been found. Judge Jon "Bo" Wood sentenced him to serve the rest of his life in prison.

Today, at news conference officials announced the remains of Theresa Parker were found off Fullerton Road in Lyerly -- southwest of Summerville in rural Chattooga County. Ironically, this is the area Sam knew very well.

In cases of Intimate Homicide when a victim’s suddenly vanishes, often when remains are finally discovered, the killer almost always goes to a place that is familiar specifically to them. In this case it was near Sam Parker’s childhood home, an area he knew better than anyone.

Today, from behind the blue wall Theresa Parker's voice, although silenced is finally going home with her family where she belongs. The discovery of her remains elimates the possibility for Parker to file an appeal (because he can no longer claim there is not a body) and ask the higher courts for a new trial.

"The Battle Cry"

Victims of intimate partner violence ,and those killed by a person’s rage for the sake of argument, is invisible in the eyes of society. We each understand, as we read about tragic cases in the news, that the epidemic exists, but it does not have a voice or a face — because the media places victims lives in the "unimportant category box." Unless a case is filled with a rapid fire of interest like Drew Peterson ,who, in my opinion, might as well have two heads. My less than favorite "dickless wonder" only gained national attention because he was a cop and two wives met their tragic end by this "clever like a fox" individual guarding and controlling his domain, in my opinion, as only a serial abuser knows how to accomplish.

There have been few cases of late that have reached the level of coverage since the Nicole Brown Simpson and Ronald Goldman murders. The death toll in this war on intimate partner homicide has risen considerably since the OJ trial and the media coverage has been nothing more than a brief burp.

 I could count the Laci Peterson murder and the death of her unborn son, but the coverage was in large part due to her mother who jumped and shouted from every roof top until the media covered the story. Laci Peterson's death was only covered because it was filled with tabloid type juicy twists and turns, when it should have received attention solely based on the fact that an innocent woman and mother-to-be lost her lost her life to war in battle due to a husband's rage.

For the thousands of other causalities whose "battle cry" has never been heard their lives must have more importance then a one liner on a grave marker.

Media coverage, other than sites such as Websleuths posting cases, or a grieving family member starting a web page in memory of their loved one, or on a Facebook page asking for information from the public in hopes of keeping interest on an unsolved case alive in hopes someone will listen, simply will fade away as if the casualty of war never existed in the first place. The unnamed soldier of war at least has a place in which to be counted and is remembered. Each year the President of the United States places a wreath on the tomb in honor the unknown soldier.

The war in the home is not a recognized battle, yet it should be. A victim cannot fight without having the necessary training and tools in order to survive. At a minimum it would require our legal system to handle cases of violence in the home as though they are positioned on the battlefield of war. From divorce to child custody, court orders of protection, to the general handing down the orders to their troops.

This is not a game. It is a real life battle involving families, children, mothers and fathers.

"Battle Cry" will work towards creating that voice for accountability and change how these cases are handled, investigated, and ultimately portrayed. Obviously, I can not do this alone. I need your help. Heed the call and join the cry..."The Battle Cry."

Domestic Violence by Police Officers: "Zero Tolerance"

I checked the definition of "Zero Tolerance" before I began this article and it means "any policy that allows no exception."

Private law enforcement Web sites around the country and the Fraternal Order of Police are in an uproar over Pittsburg Mayor Luke Ravenstahl's decision to enforce the zero tolerance policy for domestic violence by police officers.

The case is over the firing of Former Sgt. Eugene Hlavac an 18-year veteran of the police force who back in December of 2009 lost his job for assaulting the mother of his child and former girlfriend. According to court documents, the former officer was in his police uniform and, in my opinion, likely wearing his police issued weapon and oh, should I mention he practically dislocated her jaw during the incident.

Former Officer Hlavac, had been charged with simple assault for slapping his former girlfriend was found not guilty earlier this week by a judge, based largely on the testimony of a lone witness, who said that Mr. Hlavac appeared to strike his former girlfriend in self-defense after she "started to beat on the officer," the judge said. The lone witness who lives across the street from Mr. Hlavac and saw the confrontation from her car parked outside, testified that Ms. Maughan "was in a rage" and "attacked" him, Judge Flaherty said. Mr. Hlavac struck her in what the wtiness described as "an instantaneous push-away," according to the judge. "She said she didn't believe he intended to hurt her, it was in a defensive mode," he said. The witness does not know Mr. Hlavac, nor did she know he was a police officer, the judge said. "She just seemed very credible," Judge Flaherty said. "She did not strike me as the kind of person who did not tell the truth."



Because the officer was found not guilty earlier this week his lawyer will meet with the arbitration board for a hearing in hopes of restoring the officer's job with full back pay. But, this is where the case, in my opinion, gets a little sticky. You know what I mean, like gum stuck at the bottom of a good pair of shoes and you just can't get it off.

The police depatrtment fired former officer Hlavac, not because of the criminal case, but because he broke police policies or rather the "zero tolerance" as per the departments code and failure to follow the law enforcement code of ethics.. Unless, maybe at the hearing the former officer gets "grandfather" " privileges because the policy went into a affect after he was sworn in and given his police commission. Now there is a healthy arugment for his defense attorney "policy immunity."

I also should point out that the city's burden of proof in arbitration is lower than a prosecutor's burden in a criminal case.

According to the newspaper, the Mayor was quoted as saying,"the verdict doesn't mean no wrong was done or that there won't be consequences." I love that word consequences especially when it pertains to the accountability of a sworn officer who abuses their position of authority.

Before I get a lot of nasty private emails from my fan club of defense attorneys and law enforcement officers, let me make it very clear; yes, there are two sides to every story. Yes, the officer was acquitted of all charges. But, in my opinion, he should not be allowed back on the police force.

Again, my opinion is based on far too many of these officer related domestic violence cases that I am involved with on a daily basis (most involve a tragedy after the fact). Chances are this was not the first incident between the former officer and his girlfriend. It is however likely this was the first reported and documented incident of violence. Victims involved with officers rarely proceed and press charges. Most involved with officers who are abusive are in fear for their lives and we read about them after the fact because they are afraid of being killed so they suffer in silence. Women like Charoltte Grahn, Kathleen Savio, Theresa Parker, Sonia Garcia, Sandy Silcox, Lori DeKleine, Jessie Raponi, Tera Chavez, Carli Dennis, Barbara Vanaman, Crystal Brame and Stacy Peterson to name only few allegedly killed by their abusive officer husbands.

Who knows, perhaps if other law enforcement agencies adopted a zero tolerance policy maybe fewer officers wives and girlfriends would not end up being visited by loved ones bringing flowers to their grave sites.

Stacy Peterson: Courageous Young Woman & Mother Takes Control of Her Life!

This is a re-print regarding the Stacy Peterson case from 11/11/2007 . Stacy Peterson vanished on October 28, 2007. The blog is dedicating a full week to bring awareness that Stacy is out there somewhere and we need to find her.

This morning spattered across the front page of the Chicago Sun-Times..in big bold block letters "WHAT WAS SHE DOING WITH HIM? My head was spinning as I read the article with my morning coffee. Why? In my opinion Stacy Peterson is being placed on a national public serving platter like a turkey at thanksgiving being plucked away about her less than perfect childhood as an explanation for why someone like "this" marries men such as Drew Peterson.

She is after all, a potential murder victim. The public are the judge and jury as they read less than favorable words of a woman, who is not here to defend herself. So I will.

As the daughter of a Chicago Police Detective, my father was very violent. My first memory is that of my father Phillip Murphy beating my mothers head against and iron bed rail, watching the blood slowly run out of her thick brown hair and onto the wooden floor, trailing in a fine line until it made a pattern in between the wooden groves. And I, running to a chair, barely able to dial the O for the opertator, as I placed a call on the rotary telephone in the kitchen for help. When the police arrived, as they had done so often during my young years, they did nothing. Many nights my father would come home drunk and violent, the repeated behavior would become a regular part of our lives. Often my father would tell my mother " You know Roberta, no one will ever listen to you, I'm a cop, who do you think they're gonna believe." As he did so often dragging her about the house by her hair , sometimes to get his point across he'd throw her head up onto the kitchen stove and turn on a burner or two, informing her in his angry tone, "See, I could kill you right now, burn the house down with you and the kids and no one would be the wise." "So, Roberta, dummy up".

My mother finally had the courage to leave in 1988. Then in January of 1989, after they divorced as my father continued to stalk and harass her, his final act of control as in all abusive relationships was to take her life and then kill himself. He use to say, "If I can't have you no one will."

In the marriage of Drew and Stacy Peterson, she faced the same life threatening situation. And she knew it. What she did not know was that he would kill again. She believed he loved her enough not to harm a hair on her head. And that if he did she surely as I write this, had a safety net, wife #3 Kathy Savio would be her protective Armour into remaining alive. But, as most abusers do, Drew was cocky and confident in his plan, certain that no one would figure he would have had anything to do with her disappearance. After all, look at her family background. She grew up in a less than perfect home, as did many of us. And she dreamed of a better life with the first person who showed her kindness and affection. That is appealing to anyone who was read fairy tale stories as a child, wishing their life, would begin, with a prince taking her away from everything that was unpleasant and evil.

As most abusive victims will do, Stacy Peterson grew, over time, into a strong confident woman. When the abuse was no longer acceptable, she looked at her two young children, possibly thinking back on her own life and decided to make changes that did not include abuse, control and violence. She made plans to move forward, as to not repeat the cycle of violence. For that, she is to be commended.

Abusers are cold and calculating, many are also, below the radar, or in this case above the law. They plan carefully how to regain control of what they feel is their property. No different than a title to a house or a car, a relationship to thses cowards, whom we call men, equals nothing more than ownership. They grow up in less than perfect homes. They have no respect for women. Many carry the lessons learned from childhood into adulthood. Some as in this case, become policemen, like Drew Peterson. These men who abuse live among us, in our community. They attend church. They are the first to offer assistance to other neighbors. They appear to have a heart of gold. They have mastered the art of manipulation in everything they do. And, sadly, we believe them as they suck us into their less than perfect world.

To print a story such as the one today, helps no one and serves no purpose. It only adds to the plight of those women aross the county who are alive and trying to leave their abusive relationships in futher turmoil, offering no hope, but rather the continued victim blaming by our society. Instead, the story should focus on "Safety Plans" for escape, legal services and an action plan for their lives.

The real headline should have read: Courageous Young Woman and Mother Takes Control of Her Life!

Silence!

The entire month of October has been designated "Domestic Violence Awareness Month." I am not certain tagging 31 days out of 365 days is enough.

Think about for a moment. Women are killed 365 days a year, 24 hours a day. A month seems insignificant for such an epidemic. At a time when funds are being erased from city, county and state budgets a greater task is at hand to teach those caught in the crossfires within their own homes to find a way out of the toxic environment with their lives in tact. This is becomming virtually impossible when the legal system is not equipped to handle the revolving pleas for services at courthouses across America. From seeking a court order of protection by a judge, police response and enforcement of current laws to divorce and custody matters. This dyfunctional legal system is, in the end as abusive as those allowed to get away with crimes in homes across the county.

I could give example's where death could have been prevented for Amy Lictenberg's boys Jack and Duncan, Renee Pernice, Kathy Savio, Theresa Parker, Lisa Stebic, Renee Pagel, Annette Suzan Sowders-Fuller, Linda Yancey, Mary Jane Zich, Kelly Currin Morris, KellySue Ackernecht, Sonia Garcia, Tara Chavez, Stacy Peterson and the thousands of others in this war as they paid the price of silence with their lives. Nothing any of us do will bring these people back. And ignoring that we have a major crisis in the war against violence is like spitting on the graves of those murdered. But, that is what we have done as a County. With a broom and dust pan society has neatly swept these crimes down to the darkside of the basement.

The issue of domestic violence has no national platform. We have no one in Washington to lead the charge for change. I am at the place where I began more than 20 years ago, still holding out my hand asking for help in this epidemic of silence.

A Walk For A Life Lost!

This October it will be 2 years since the 23 year old mother of two, Stacy Peterson vanished. While friends and family continue to look for her remains there are others out there alive whom desperately need our assistance. Funds are being cut for children, legal and shelter services for woman across the country. Agencies whom provide these vital and life saving services now depend on every penny to help its' victims.

Last week on The Susan Murphy Milano show we had as a guest Amy Leichtenberg. She is the mother of Duncan and Jack whom were assassinated last year by their father while on an unsupervised visatation. Allowed by our court system to slaughter innocent children. On the show Amy talked about what got her through the court system while her children were still alive she said it was the programs provided by the agency in her area. She talked about the counseling for her and the therapy and children's programs for her kids. "They looked forward to going each week and healing."

Whether you live in Kansas or California we all saw the news coverage for some 18 months before my least favorite cowardly"dickless wonder" was arrested for the murder of Kathleen Savio. I realize we cannot bring these women or their children back among the living, but, we can take action and support services that are providing a life line for victims of violence and their children.

We all watched the news coverage on MSNBC, Fox News, ABC, NBC, CNN, HLN, our local stations as they brought the horrific plight of two women's lives across our television and Internet screens Kathleen Savio and Stacy Peterson as their abuser strutted on screen saying "Stacy took off with $25,000 and a red bikini or she left with another man."

We need to send a message of hope to the surviving children of Stacy Peterson whom will never see their mother again by either participating in the event below or making a monetary contribution in honor of Stacy Ann Peterson. The information is below, please a moment to donate whatever you can.

Painting A Bloody Blue Picture?

Before the Robert Vanaman trial beings next week, attorneys on both sides gathered together one final time.

Vanaman, 40, a former Millville, NJ police officer is charged with his former wife Barbara's murder, criminal restraint, possession of a weapon for unlawful purposes, tampering with evidence, hindering prosecution and obstructing the administration of law enforcement.

He was arrested in November 2006, more than six months after he fired two bullets into his Wife’s chest during a domestic dispute inside the kitchen of couple's home.

This case has taken a long time. I am concerned about this case in particular. This is a small town. The defendant Robert Vanaman is a respected member of the community. Vanaman comes from a law enforcement family. According to sources Barbara Vanaman was afraid of her husband. As most women married to an abuser are who happens to be a police officer. rarely are reports made after a dispute. Often as in this case, supervisors may have been called to the Wedgewood Court home, but, refused to make a report against their supervising Sargent. And of course records have vanished.

Barbara sought the advice of a divorce attorney. She had enough of the threats and ongoing abuse by her then husband "sweet" Robert.

The defense will attempt to use psychological records in an attempt to paint a picture that Barbara had mental health and anger issues. I am outraged when I see the same song played as it pertains to those women married to an abuser who carries a badge and a gun. This case is a perfect example. The victim’s life prior to her murder should have no significance in a court of law. And yet, it will be the center of attention in this case. It does not matter what she did or did not do. The fact is Barbara Vanaman is dead.

Did she have training to properly defend herself? Answer: No

Did she make Robert Vanaman pull the trigger? Answer: No

Did she go after Robert in the kitchen that afternoon? Answer: No

Did she try to leave her abusive relationship? Answer: Yes

Is Barbara Vanaman on trial? Answer: Yes

Cowardly Cutts Files For A New Trial

Bobby Cutts who was sentenced to life in prison for killing his pregnant girfriend is asking for a new trial, arguing that the jury handed down verdicts that contradicted each another.

The news of the OJ Simpson Verdict probably knocked this off the media's radar.

Lawyers for Bobby Cutts Jr. filed the appeal this past Friday.

Let me refresh your memory if case you forgot . It was Cutts, that a jury found guilty in February [2008] of killing Jessie Davis and their unborn daughter at her northeast Ohio home.

Prosecutors argued that he killed Davis, 26, and the fetus last summer to avoid making child support payments.

Jurors convicted Cutts of aggravated murder in the death of the fetus. They found him not guilty of aggravated murder in Davis' death but convicted him of a lesser charge of murder.

According to ABC NEWS The filing argues that convicting Cutts of murder in Davis' death and aggravated murder in the fetus' death was inconsistent because both deaths were the result of the same act.

"The jury clearly lost its way and created such a manifest miscarriage of justice that the conviction must be reversed and a new trial ordered," the appeal said.
Cutts attorneys also argue that the Stark County judge presiding over the trial should have allowed jurors to consider an involuntary manslaughter conviction because no witnesses contradicted Cutts' claim that he did not purposely kill Davis.

Cutts testified that he accidentally hit Davis in the throat with his elbow during an argument, and that he dumped her body in a panic.

Violin Music please. The also says that Cutts did not receive a fair trial due to all the media coverage.

It was Jessie's mother who during sentencing while on the stand said "she wanted his life spared". In my opinion had she not made that plea for his life he would have received life or the death penalty.

"Think about the children" were the final words from Lori DeKleine's lips just before her estranged police officer husband, Ken DeKleine, murdered her on January 10, 2008.

The trial began on Tuesday in Grand Haven Michigan. The Prosecution ended their case today.
The defense presented no case, their client had confessed on video to Lori's Murder.

The tin badge coward of the law, well regarded by his fellow Holland Police Officers, staged the crime scene, in the basement of the home they once shared to make it appear Lori, had committed suicide.

This coward of a man, left the body in the basement for the couple's teenage son to discover. The young man will never recover from the smell of death and images of seeing his life less mothers body and the nylon strap tied around her neck. He will be haunted and reminded for the remainder of his life.

Like most abusers, Ken Dekleine was obsessed that his wife was romantically involved with another man. In this situation, her therapist. He was angry when she secured an order of protection against her police officer husband in January of 2007. Placing blame on the therapist for interferring and brain washing his wife.

It would be Ken DeKleine would would take a mistress sixteen months prior to the murder.

Richelle VanderWal was also married to a police officer at the time, and in the midst of a divorce when she met DeKleine.

Tomorrow, closing arguments begin.

This is not just another tragedy, of a controlling abusive police officer gone bad. Likely to receive
a life sentence.

It is the tip of the iceberg. A glimpse if you will, into reality of what law enforcement wives married to these cowardly tin badge abusers endure, daily.

Police Chief's and the National Fraternal Order of Police need to wake up to the reality their union paying members are committing crimes within their own famiies.

Support the officer and include the family. Yes, the family. You know the wife who has to be careful when her officer husband returns home after shift, because he is drunk. Angry over pressures on the job. Maybe he found a child sexually violated, murdered and left in a swallow grave. Perhaps he was called on a crime scene where an elderly couple was robbed and then murdered. How is a police officer suppose to cope and survive? Where is a police officers wife suppose to turn when the officer turns the gun on her? Where is she suppose to go when her life is in danger?

Provide programs for officers who see the worst of human tragedy, daily. Work with Prosecutors around the country, implementing healthy and safe program for the wives and children.

In ignoring this national epidemic within the law enforcement community, the "Blue Brotherhood" are just as guilty.

Officer Friendly in a Not So Friendly Way

During the first half of June Officers listed below have been arrested for crimes related to their own personal family violence. Over at http://www.behindthebluewall.blogspot the site brings awareness to an issue that remains behind closed doors. For a police officers family, wives and children, they have no place to turn for assistance from a system that slaps the offender on hand who also happens to be in law enforcement, these are just a handful of the thousands across the country that are swept under the rug and never get reported.

Becca McEvoy: Justice In Limbo

The family of Becca McEvoy returns to court today in Mobile Alamaba fighting for justice for a little girl they say was raped by her police officer stepfather, Bob Ingel. Rebecca McEvoy, 11, was killed in a car crash last January.

Before she died, unexpectedly, Rebecca had been before the grand jury, testifying in hopes of seeking justice against this alleged sexual predator. According to prosecutors, a medical exam confirmed Rebecca had been raped, but Ingle's attorney is hoping a 2004 Supreme Court ruling will keep the case from ever going to trial.

Today, a Mobile County Judge is expected to decide whether a defendant can stand trial without having an opportunity to confront his accuser.

The lawyers are using the "Crawford" case out of Ohio. This says “you have the constitutional right to cross examine your accuser” and because the girl is dead and cannot testify, there is a chance the Judge may throw out the case.The Assistant District Attorney, Steven Giardini, believes the case law should not be applied in Becca McEvoy's case.

The legal team is now using new words as they prepare for their day in a courtroom, should it ever arrive, when an arrest is made in either case. I was struck by an article that appeared here: Title of article:" Lawyer Claims Vendetta"

Definition of a Vendetta for those who attempt to throw it out and see what sticks is:

a feud in which the relatives of a murdered or wronged person seek vengeance on the murderer or wrongdoer or on members of that person's family ;
any bitter quarrel or feud ;

What is the legal team of campfire roasters implying in using this terminology? There is no bitter battle. Can you blame friends and family for wanting to know where Stacy Peterson is?
Certainly, not. After all, it was Drew Peterson who said himself, "she is where she wants to be".

And it is not the neighbors "job" to locate Mr. Peterson's wife, who according to the legal team of roasters, obviously believes Sharon and her son Roy should be doing.

No one, sir, is seeking anything, but the truth. And for you or anyone, particularly those who have been arrested for domestic violence themselves, or been visited at their own home by members of a swat team, to imply otherwise further proves the camp marshmallow club of offenders is alive and well.

Now, 136 days have passed, the children are still without their mother. The world is a cold enough place when the only warmth and love of a woman a child knows is abruptly taken from them at the most important time of their lives.
