What Would Susan Say: Where's Stacy?

Is it ironic that on October 28, 2007 Stacy Peterson was never heard from again, silenced in the prime of her life, most likely at the hands of her husband Drew because of the secrets she held so long?

On October 28, 2012, another Sunday morning, exactly 5 years later, another voice, Susan Murphy Milano, was silenced in the prime of her life, taken by the hands of an abusive disease, because of the secrets she held so long that caused pain and stress in her life and contributed to her disease.

What would Susan say?

After a week of being in the fog zone, with time being insignificant, you can almost hear Susan shouting,

"Ok, enough about me already! You all have work to do! It's not about me, you know where I am, but, how are you going to find Stacy?"

From the beginning days of the Stacy Peterson case Susan was deeply affected, not only because she recognized the fact that Stacy most likely wasn't coming back, but because she saw similarities between Drew Peterson and her police officer father, the smug attitude and the fact that each of them thought they could get away with what they had done behind closed doors.

Immediately Susan picked up on the nuances of the case, before national media attention, and made no bones about what she wrote, sympathetic to the family members, but calling out what she saw from first hand experience living with an abusive cop. She saw through Peterson and his "Legal Marshmallow Roaster" attorney and knew exactly what they were up to, doing everything to divert attention away from Stacy.

In the midst of the circus of media, online forums, and news reports was a young mother, Stacy, who held within her being a secret she hoped would be more of an insurance policy. Stacy confided this secret and most likely lost her life because of it.

Because of Stacy, Susan was inspired to create the Evidentiary Abuse Affidavit. Had Kathleen Savio had the opportunity to create her own EAA, perhaps Stacy would still be around. Had Stacy done the EAA, the public would not have been subjected to the years of buffoonery created by Drew Peterson and his campfire team of attorneys and public relations ringmasters.

Peterson’s pattern of conduct and actions are important as it relates to Stacy Peterson. She can be placed in the marital home the morning she disappeared, so we know she and Peterson were in that house. From Sunday morning until the following day, there is a window of opportunity for Peterson, and when the coast is clear, in my opinion, he takes her out of the house. How far is he really going to drive? Does he go to one of two camp grounds with which he is familiar within an hour’s drive of the house? Does he go to a more obvious and public location, perhaps in plain site and one that is familiar to him? We do not know because Stacy Peterson is still out there someplace waiting to be found.......Stacy Peterson's Tragedy: Saving the Lives of Others, October 27, 2011

Now that Drew has been convicted of the murder of his previous wife, Kathleen Savio, and we see the latest news about appeals and possibly a second circus act, Susan would want us to remember the most important fact:

STACY PETERSON IS STILL MISSING.

Whatever the significance of the October 28 date may be, it's no coincidence in the universal order. It's a date that both Susan and Stacy will be remembered in the future, somehow still connected to each other.

The world has the opportunity to change the way intimate partner violence and homicide is handled, something Susan vowed she would do in 1989.  The challenge is: "Who Can Fill Her Shoes?"

On October 28, 2012, Susan Murphy Milano lost her battle with cancer.

Her latest book, a "true crime memoir" based on the experiences of her life, HOLDING MY HAND THROUGH HELL, was released earlier in the month.

The Susan Murphy Milano Show "Time's Up!" Thursday 2/2/2012 at 2pm ET

Everything Old Becomes New Again!

Neil Schori,ImaginePublicityFrom her visit with Pastor Neil Schori, in the same church where Stacy Peterson confided in him, Susan Murphy Milano and Neil Schori assisted several women in the completion of their individual safety plans and the all important, Evidentiary Abuse Affidavit.©
As Pastor of Naperville Christian Church,  Schori has had the opportunity to be more than just a Pastor giving a sermon each Sunday and teaching the lessons of the Bible to his congregation.  Neil’s works go far beyond the pulpit, and as a young, well versed individual, he speaks to those who may not otherwise hear his messages.
Neil has devoted much of his time and talent, not only with providing aid to Haiti, but also advocating and assisting victims of violence within his community. He is listed on the National Registry as a Certified Trainer on Document the Abuse (documenttheabuse.com) and is available to train for first line responders in the E.A.A. Model of Approach.  Neil is currently organizing others in the faith based community to embrace the issue of intimate partner violence and urging them to take a larger role in it’s prevention by reaching within each church and community to provide the simple, but effective procedures as seen at Document the Abuse.

Listen Live at www.herewomentalk.com
———————–
Susan Murphy Milano has worked with victims of violence for over 20 years following the death of her mother at the hands of her police officer father who brought the violence of the streets of Chicago home each day. Green to the gills on how the “system” worked, Murphy Milano hit the streets vowing to change the way the world looked at victims of violence and improving on services and procedures available to women like her mother.
One of those surviving victims from the past will join the show to discuss how she was badly beaten and left for dead. One of several very high risk cases that were passed to Susan Murphy Milano as a last resort, Jackie Keys will recount what it was like back then, in the early 90′s, what she was taught to do to survive and move into a new life, free of violence and the abuser who attacked her.
Along with Jackie Keys from the past, Tracey Murphy makes another appearance relating present day procedures, lack of resources, and the overall climate in assistance for victims of abuse.  Tracey will talk about what helped her and her children get out of an abusive relationship and what she’s doing today to keep her family safe from the abuser.

Drew Peterson Remains Behind Bars and Stacy Peterson Remains Missing

Earlier today, the Illinois Supreme court denied a motion from the defense team of Drew Peterson's to be released from jail while they review the appeal filed by the Will County State's Attorney's office in the case. Peterson has been behind bars since he was charged in the murder of Kathleen Savio in May of 2009. His bond remains at $20 million dollars.

On another note, Peterson in the news should be a reminder to the citizens of Illinois, Stacy Peterson, mother is still missing. Next month will mark the fourth year anniversary when she was, in my opinion, erased from the earth.

Hunting season is also around the corner, so perhaps hunters can be reminded through the Illinois National Resources websites to be aware and keep their eyes open this hunting season.

And social sites can continue getting Stacy's information out to the public. From Facebook to Twitter  to web and community sites and faith based organizations.

Stacy Peterson was silenced, we are her only voice, let's get busy!

Drew Peterson: Statement of Facts versus Hearsay Law

Drew Peterson is awaiting trial for the murder of Kathleen Savio, his third wife. The State in this case is working on the admittance of "hearsay testimony." Tomorrow the issue will be brought up again in a Will County court house. News cameras will also be covering the hearing.

Drew Peterson's rein of abuse has spanned over 30 years. Stacy Peterson, the fourth wife of Drew Peterson, is now a missing person case. Her statements to police at the time of Kathleen's death in my opinion are an important factor in this case. And yet, frankly, the arguments do not make sense as it relates to certain statements while Stacy was alive that should be allowed when Peterson goes to trial for the murder of Kathleen Savio. My question is how does this go to hearsay?

What is troubling to me, the attorney Harry A. Smith who represented Kathleen Savio during the divorce and then later met with Stacy Peterson for a divorce consultation just a few days prior to her disappearance. As an officer of the court wouldn't his statement of facts also be entered on the record, for both women?

Kathleen Savio sought every legal remedy in her situation. From begging the State's Attorney's office to help her-to going to court for an order of protection. This process included Kathleen going before a judge swear to the facts that he was trying to kill her, in a court of law where she was ultimately granted an order of protection. Does this also not go to Kathleen speaking in her own words as admissible fact during the trial?

Hearsay is an out-of-court statement "offered for the truth of the matter asserted" and is not subject to cross-examination, typically because the declarant or speaker is unavailable. This applies to Stacy Peterson because she is not "available." Such statements are deemed unreliable because of the obvious fact that they can easily be fabricated and can not be tested through crossexamination.

One basic way to get around hearsay is to seek admission, not for the truth of the statement itself, but for another highly relevant purpose. For example, let's say I am charged with intentionally shooting my daughter's boyfriend (which is not beyond the realm of reason) while the two of them are harmlessly playing tie-up. Prior to bursting into the room and firing, I was told by her ex-boyfriend that the new guy was in the process of raping her. My defense is not intentional murder, but, rather, manslaughter because I believed the ex, who has since fled to Costa Rica and is unavailable at trial. Here I would offer his statement of rape, not because it was true, but because of the effect it had on my mental state, a very relevant fact in the case. Again, I am not offering it for its truth and therefore whether it was fabricated is not in issue. Whether the statement was made and whether my response was reasonable (based upon my credibility) can all be determined by the trier of fact at trial because I, not the ex, would be subject to cross-examination. In any event, statements can be admissible solely for their impact upon the listener (if relevant in a case) and not for the truth of the statement.

This approach should be very relevant to the statement Anna Domain (Kathleen Savio's sister) could testify to, "that Kathleen asked her to care for her kids." This is dynamite. Not offering it for the truth that Peterson said he wanted to kill her, but for the independent impact it had on her and her mental state to seek care for her children. Anna Domain could testify to her observations regarding Kathleen's credible belief that she needed to secure care for her kids because she was going to die soon. This really should have tremendous impact on the State's case, assuming Anna Domain is well prepared on the stand. And fear is hearsay with no subsequent act reflecting impact on her mental state.

Now for the exceptions, which have literally swallowed up the general rule. Since the beginning of time, Courts have recognized certain fact patterns that contain such inherent elements of reliability that they overcome the need for cross-examination. All of this is based on a notion of getting all relevant information to the jury that is subject to a prejudice in the analysis of the defendant. For the State this stuff is worth fighting over because it usually means game over for the defendant. Certain fact patterns below have crystallized into exceptions.
  • Dying Declaration - declarant unavailable says just before dying to witness "Mr. X shot me." This is admissible based upon the notion that people who are dying do not typically have a motive to lie. Witness will testify as to demeanor of declarant.
  • Excited Utterance - declarant screams "the plane is going to crash into the house" and witnesses doesn't see the plane. Here admission is based on the fact that when people are experiencing a startling event under stress they don't have time to fabricate.
  • Present Sense Impression - this is the same as above, except the witness also experiences the same event as the declarant, and therefor the declarant's statement is relevant.
The exception used the most by prosecutors, and the one that is highly relevant for Peterson purposes, is a Statement Against Interest. For example, if I told you that I "did dope and shit," the statement would be admissable based on the theory that people do not make up highly negative evidence against themselves, especially facts that would subject them to criminal prosecution.

This is highly relevant for Stacy's statements to Pastor Neil Schori and Mike Rossetto that she provided an alibi, because it shows that she was willing to obstruct justice at Peterson's direction regarding Kathleen. Now maybe during the admissibility hearing the witnesses were weak on the statement, or just did not provide enough detail regarding the circumstances of the meeting with Stacy to overcome the highly prejudicial impact of the statement.
I realize when this was written it was intended for the general public. Each time I come across these words I think of the evil one individual has caused to many lives. In my opinion, Drew Peterson multiplied his evil rein during 3 decades. Two innocent lives lost. That is not hearsay, but fact.

"The ultimate weakness of violence is that it is a descending spiral, begetting the very thing it seeks to destroy. Instead of diminishing evil, it multiplies it. Through violence you may murder the liar, but you cannot murder the lie, nor establish the truth. Through violence you may murder the hater, but you do not murder hate. In fact, violence merely increases hate. So it goes. ... Returning hate for hate multiplies hate, adding deeper darkness to a night already devoid of stars. Darkness cannot drive out darkness: only light can do that. Hate cannot drive out hate: only love can do that."- Martin Luther King

Following the Money Trail Leading to Murder!

Earlier in the week A& E Biography profiled former Bolingbrook Police Sergeant Drew Peterson whom is locked up in a Will County, Illinois jail awaiting trial the murder of Kathleen Savio.

Whatever hair the Peterson team lead legal marshmallow roaster does not have left on his head, I am sure the "source" that leaked the $15,000 his client received for payment made public in Michael Sneed's column was more than a shock. And my hats off to Michael Sneed for reporting on this fact. Especially, when he's oh so close to the reporter, was not given a head's up.  I am sure he is fuming as to who leaked the information and if he thinks for a moment, it's a short putt.

Apparently Peterson supplied photos and videos for the A& E program.  In exchange he received a $15,000 payday that will go towards paying "his" expert at trial.

Interesting and very sad at the same time, from behind bars he is still collecting dividends from, in my opinion, murder.

I had a thought about the money.  Since Stacy Peterson is still missing and he is still legally married to her doesn't half of that $15,000 belong to her?  What about all the money he gave his son?  Isn't that also a marital asset?  The house, isn't that still jointly in the name of Stacy Peterson?  How is he allowed to pay for a defense when half the money is hers?  Would the Will County States's Attorney's office be able to freeze assets by court order until such time it is determined where she is? Or pending the outcome of not one but, perhaps 2 trials?

Drew Peterson was paid for a show about himself when there is a young woman and mother of two still missing.  He has benefited in so many ways while we all know he was the very last person to see her alive.

Follow the money trail it all ends to the road of murder.

Tiffany Hartley: Part 3 A Call To Action

by Susan Murphy Milano and Peter Hyatt

If you or I were asked to take a polygraph to clear any suspicion in an alleged murder of a child, husband or crime, without hesitation, we would jump at the opportunity to facilitate whatever means possible to remove all doubt as a possible person of interest or suspect and expedite the investigation. This has been the call of sense from Adam Walsh, Marc Klass, and others for years. It is something that can be done within an hour, and allows investigators to move on past innocent family members and further the investigation. Men like Walsh and Klass urge families to polygraph immediately, even pressing law enforcement to move as quickly as possible.

In an interview with Jane Valdez Mitchell- Tiffany Hartley says:
HARTLEY: I can`t even describe the pain and the fear that I had of when I turned him over. I didn`t know what to expect, you know. Of course I was hoping maybe a shoulder or something. But I didn`t know what to expect, and I was sure not expecting that he would be shot in the head.

Don't interpret Tiffany's words; just listen to her.

She is telling us that she will is unable to describe what happened in hopes that we will just take her word for it thus allowing her to move on and discuss the border issues, pirates and the Mexican cartel. Since then, she has added the issue of illegal aliens taking jobs away from Americans, a provocative and emotional issue.
She has draped her cause in religious language, eliciting sympathy from Christians.

Tiffany Hartley is unable to describe what happened because it may implicate her.

“I didn’t know what to expect, you know, of course I was hoping maybe a shoulder or something.”

"you know" is a habit that enters language when someone is stalling for time to think.
"of course" is employed when a subject wants us to accept what is being said.

"I was hoping maybe a shoulder"

Huh?

What does this mean?

Tiffany Hartley was hoping for a "shoulder" hit? Investigators should look at this unusual language to learn if Tiffany Hartley is experienced in handling weapons, and in particular, hunting. "a shoulder" sounds like hunting language, and when she added "of course" it sounds premeditated; she thought about where she would like him to be shot.

Note the inclusion of thoughts within the story. When thoughts and/or emotions are added to an account, in "the perfect place", it is a strong signal of deception. Why?

It takes a long time to process what happened during a tragedy. Law enforcement has learned through decades of research that only the guilty and deceptive will add thoughts and emotions into an account as an attempt to persuade rather than report. When someone goes through a tragedy, the hormonal rush means "fight" or "flight" and there is not an inclusion of thoughts and emotions as the subject is on raw survival. When thoughts and emotions are included, it may come after the "event" in an account, but when it is included in the "perfect place", i.e, during the event, we are staring at deception.

As the subject works on recall, the "thinking" process came afterwards, which is why a report has 3 basic sections:

1. Introduction
2. Event
3. Post Event

The breakdown will come naturally, as truthful accounts will have a short introduction (what happened leading up to the event) of about 25% of the account.

The event is the most important part of the report and takes up about 50% of the account. In a truthful report, this section is void of thoughts and emotions.

Post Event is what happened afterwards, including callng 911. At this part of the report, some will include thoughts or emotions, especially if safety is reached. This will only be about 25% of the account. Any major deviations from this breakdown indicate deception "on its form". But the inclusion of thoughts and emotions within the main event also show deception. This is where Tiffany said the "pirates" were close enough to hear them and that "they decided to leave" in some of her accounts.

HARTLEY: It`s hard being judged and thought of that I might have done something to him, but I -- like I said, I know what I know. And as long as I, you know -- I know the truth, God knows the truth. And other than that, it almost doesn`t really matter it to me, because I know what happened that day.

Note several things within this statement:

"like I said" is a self-reference
"I might have done something to him" is found within her statement
"it almost doesn't really matter" has two qualifiers, "almost" and "really", showing that it very much does matter.

So why not take a law enforcement administered polygraph? If it is hard to be judged, end it with a law enforcement administered polygraph.

http://archives.cnn.com/TRANSCRIPTS/1010/08/ijvm.01.html

Drew Peterson, like a bad recording said “I know the truth” and I recall when Nancy Grace asked him during an interview she said then tell us the truth Sgt. Peterson and in pure Peterson style he ended the conversation before commercial with "God knows the truth". He claims Stacy Peterson ran off in a red bikini and $25,000 in cash. That is the story he has told from the day Stacy Peterson vanished on October 27, 2007.

Nearly 3 years later, a petite woman tells the tale of how she was shot at, not certain if she was behind, in back, alongside or in front when she saw, heard or knew bullets were being fired. She went back from someplace to get somewhere to turn him over to see the back, front, ultimately leaving him there and hearing that voice from God to just leave while bullets were flying and escaped. And how she knew if it happened on the Mexican or Texas side is anyone’s guess, but the constant repetition of "on the Mexico side; on the Mexico side" shows just how sensitive and important it was to Tiffany that everyone know that "this" did not happen on the US side; giving US authority to investigate. She made this clear from the moment she got out of the water, first to the 911 operator, and then repeatedly in interviews.
In criminal law "Overt Act" is defined as , an overt act , an open act, one that can be clearly proved by evidence, and from which criminal intent can be inferred, as opposed to a mere intention in the mind to commit a crime. Therefore, it is an act that, while innocent per se, can potentially be used as evidence against someone during a trial to show his/her participation in a crime. For instance, a rental of a van and a purchase of a gun are overt acts as part of an assassination.

The overt acts of Tiffany Hartley, once properly investigated by authorizes will help guide the investigation and open up many doors for exploration. We are not amused by her shopping spree, or her juvenile emotional posts or her shopping sprees. We are alarmed at how few in media have asked strong questions of the only known eye witness into the disappearance of a young man. We want an answer to our question:

Is Tiffany Hartley involved in the shooting of David Hartley?em>
This is the question that needs to be answered. In the United States, all of us have the presumption of innocence in a court of law.Tiffany Hartley is judicially innocent of the disappearance of David Hartley. This must be the presuppostion for her, and for everyone else. This is how our judicial system works.

An investigation needs to be done. David's family deserves this much.

Tiffany: Call the FBI and volunteer to take a polygraph administered by them! Tell your followers on Facebook that you wil do this today. Show your love for David that you profess publicly.

You have taken this case public and have given us the right to question your story. Unlike the Zapata County Sheriff's Office, we do not simply accept your word for it, or any other single witness' word on any murder case.

"Trust, but verify".

AS for the current elected Sheriff, let us remind him that he took an oath.

On their Website it says: "The mission of the Zapata County Sheriff's Office is to maintain social order and provide professional law enforcement services to citizens in the community, including, but not limited to, victims of crime, the elderly, and the youth, within prescribed ethical, budgetary, and constitutional constraints. This office strives to enforce the law and maintain order in a fair and impartial manner, recognizing the need for justice, and consistent appearance of justice."

David Hartley was a victim of a crime and he lived in Texas. He was a US citizen and deserves justice. His family deserves justice; something all US citizens expect.

And unless it can proven otherwise he died somewhere in Texas, either on land or in water. If the call placed to 911 was received by an emergency operator in the United States, then this is wherethe jurisdiction of that call goes to. It a referral is needed, it comes from Zapata County.

We have spent considerable time outlining facts in the murder of David, and as a sworn public official of that office the Sheriff likely needs a bit of assistance from the public at large.

First, paperwork should be filed immediately on David Hartley as a missing person. This is something his family can do, without Tiffany which will have David Hartley’s case entered in missing person’s database and eventually www.nameus.gov.; and then onto an formal investigation.

Resources and budget constraints should not be an issue in this case as numerous agencies i.e. the Attorney General’s Office, homeland security and the FBI are awaiting your telephone call for assistance and funding you may require for this case.

Next, Law Enforcement must call out Tiffany Hartley with a public request for a polygraph. Since she has designated herself as a "voice" for America, and is now on a public mission, let the call to clear herself also be public. Should she decline, the family will process this and continue on to press for an investigation into his disappearance.

We can all write to Zapata County Sheriff's Office and insist upon an investigation and remind them that as a citizen of the United States, David Hartley deserves this much.

Gov. Rick Perry has been outspoken on this case, we can write to him and demand an investigation and justice for David. He can assign this for investigation.

Until we see a formal investigation and justice for David Hartley, we will not rest.
