Family Court Crisis: Rewarding a Killer Visitation for Charlie and Braden Powell ends in Murder

On Sunday, Charlie 7 and Braden 5, the children of missing Utah mother Susan Cox ,were murdered. The children were blown up in an explosion during a court ordered visitation with a dangerous psychopath.

Susan vanished on December 6, 2009 from her Utah home.  If you recall Josh Powell had suddenly, taken the children then ages 2 and 4; camping in freezing temperature at midnight.  When interviewed Susan was reported missing, the case covered by the media just prior to securing an attorney, Josh said he didn't know where his wife was and she just left.  In the days following, Josh would say she left with another man. He would be the only person named by police in the case.

As in each one of these intimate partner missing homicide cases, the last person to see their wife or girlfriend, is almost always the person responsible for making them vanish. The pattern of conduct in this case prior to Susan vanishing, then afterwards, is significant, and often overlooked by law enforcement.  Josh Powell was allowed to leave the state of Utah moving  into his father's home with the two young boys.

Many experts of across the country, Reporter Isabelle Zehnder, Statement Analysis Expert Peter Hyatt, Attorney Anne Bremner, Legal commentator and defense Attorney Holly Hughes, among others, discussed the imminent danger to the boys lives.  At one time or another we predicted if the legal system didn't remove the children, they would be murdered. Last week permanent placement of the boys was given to Susan's parents Chuck and Judy Cox.  Josh Powell by a judge was given supervised visitation like a prize for being the biological father. What was this judge thinking? Powell posed a threat to his own children's lives.

The murders of Charlie and Braden's were by all accounts preventable.

The family of Susan Cox requires not only prayers, but the promise that on the blood of their grandchildren, the epidemic and ignorance in the family courts across the country will do more than award murder's visitation and custody of children, especially when their mothers are missing intimate partner homicide victims!

Let's also remember Susan Cox is still missing and she requires our attention to be found.

Topeka Kansas: Failure to Protect Violates Statutes

The hour heated up in the Zeus Radio Studio starting with a discussion about the city of Topeka, KS decision to stop prosecuting domestic violence cases with my suggestion that the District Attorney obtain permits and go into the cemetery business. The city of Topeka is throwing victims' lives to the wolves disguised in sheep's clothing, more commonly known as the violent offenders.

The city is hiding behind the budget because frankly Kansas does not see intimate partner violence a crime.

Shawnee County District Attorney Chad Taylor and Interim City Manager Dan Stanley met today to discuss the prosecution of misdemeanor cases occurring within Topeka city limits. The meeting centered on how best to preserve public safety given recent budget cuts sustained by the District Attorney’s Office. Both the District Attorney’s Office and the City of Topeka are hopeful that an amicable agreement will be reached shortly that will be in the best interest of all Topekans. Discussions will continue over the course of the next few days and will focus on crafting a mutually agreed upon resolution that will ensure the efficient prosecution of all city misdemeanors.

According to the National Coalition against Domestic Violence, current data, there are 16,800 homicides (reported)attributed to intimate partner homicide per year and $2.2 million in medically treated injuries costing $37 billion per year!

Is Topeka Kansas in violation of their very own State Statues?

• 22-2307: Domestic violence calls; written policies to be adopted by law enforcement agencies; contents. (a) All law enforcement agencies in this state shall adopt written policies regarding domestic violence calls as provided in subsection (b). These policies shall be made available to all officers of such agency.(b) Such written policies shall include, but not be limited to, the following:
  (1) A statement directing that the officers shall make an arrest when they have probable cause to believe that a crime is being committed or has been committed;
  (2) a statement defining domestic violence;
  (3) a statement describing the dispatchers' responsibilities;
  (4) a statement describing the responding officers' responsibilities and procedures to follow when responding to a domestic violence call and the suspect is at the scene;
  (5) a statement regarding procedures when the suspect has left the scene of the crime;
  (6) procedures for both misdemeanor and felony cases;
  (7) procedures for law enforcement officers to follow when handling domestic violence calls involving court orders, including protection from abuse orders, restraining orders and a protective order issued by a court of any state or Indian tribe;
  (8) a statement that the law enforcement agency shall provide the following information to victims, in writing:
  (A) Availability of emergency and medical telephone numbers, if needed;
  (B) the law enforcement agency's report number;
  (C) the address and telephone number of the prosecutor's office the victim should contact to obtain information about victims' rights pursuant to K.S.A. 74-7333 and 74-7335 and amendments thereto;
  (D) the name and address of the crime victims' compensation board and information about possible compensation benefits;
  (E) advise the victim that the details of the crime may be made public;
  (F) advise the victim of such victims' rights under K.S.A. 74-7333 and 74-7335 and amendments thereto; and
  (G) advise the victim of known available resources which may assist the victim; and
  (9) whether an arrest is made or not, a standard offense report shall be completed on all such incidents and sent to the Kansas bureau of investigation.

Heather Mallory Trial: Verdict Guilty of Murder

A jury found Brian Cole guilty of murdering his wife Heather Mallory, 32. She initially went missing in March of 2008. During a heated argument in the home, and because Heather was ending her violent relationship with Cole, he beat and then strangled her to death, then stuffed her body in a duffel bag, hiding it in the forest.

Heather was listed as a missing person until 2010. Her husband, just as many of those who kill their wives and girlfriends “claim” she took off and he did not know anything as to her whereabouts. Cole, like so many others before him, are not able to allow the person in the relationship to leave with their life. He watched her die, his last act of control over her as a punishment for wanting out.

Cole moved out of the State of Oregon two months after Heather was reported missing, moving to Idaho with the couple’s young son. Cole likely believed that if he moved away, authorities wouldn’t charge him with her murder. It should be noted that the jury read the verdict, he cried like a cowardly baby.

When Brian Cole murdered Heather, he didn't just take her life. He hijacked his young son from forever knowing the love of his amazing mother, forever.

Intimate partner homicide continues to the number one cause of death to those whom experience violence in their relationships.

Before anyone says to their husband or boyfriend they are ending the relationship; they must complete the abuse affidavit and video as exampled below:

The Evidentiary Abuse Affidavit: A Victim’s Voice(c)

Domestic violence or intimate partner victims now are able to provide information, in their own words, about the fears, dangers, experiences they have had at the hands of their abuser. The" Evidentiary Abuse Affidavit" or "EAA" records victim's stories, histories, and experiences which are preserved and stored on their behalf. These videos will provide answers to the many questions, allegations, and fears that arise when a person has disappeared, gone missing, or been found dead.

Numerous cases, such as missing mother Susan Powell of Utah, Kelly Rothwell of Florida, and women like Stacy Peterson, where the victim’s police officer husband is the person of interest, is the classic example of the benefits of this type of evidence. If Stacy Peterson, or any woman found murdered or is missing, had done an Evidentiary Abuse Affidavit, ON TAPE, from following the information in the “Time’s Up" book on a flash drive, they would be able to describe:

Gail Nowacki Palmgren: Beyond the Mountain Top

Dr. Gail Palmgren age 44, mother of 2 vanished from Signal Mountain TN, on April 30, 2011. Weeks before she was in the process of ending her marriage. Gail does what I have instructed victims of intimate partner violence to do for over twenty years, tell a trusted friend.

Gail Palmgren confides in Arlene Durham, her best friend. She gives her various items, paperwork to hold for safekeeping, keys to property, along with her verbal and email instructions to pick up a dvr at best buy. Because of various spyware applications on cell and her own personal computer Gail is unable to facilitate certain safety plans as it relates to leaving. Her best friend, Arlene gives Gail her laptop to use.

At the urging by Gail's relatives and Arlene, Matt Palmgren reports his wife missing. Arlene gathers everything given to her by Gail and goes to the police making every effort to tell them what she knows and hand everything over. The police response was dismissive. Signal Mountain Law Enforcement decide to turn a deaf ear.

How many of missing persons cases's involving women and mothers in the process of ending their dysfunctional and often violent relationship have to go missing before it is taken seriously by law enforcement?

The case is now 56 days-cold! Many a missed opportunity, erased by, in my opinion, incompetence in this particular missing persons case. Arlene Durham's only "agenda" is finding her best, Gail. She has important information in this case that I believe is of significance to what happened to Gail Palmgren. Speaking from experience, no one listened to my mother, or all those thousands, like her who go missing each day. The crime of intimate partner violence that leads to homicide is still dealt with in silence behind closed doors. I am one of the lucky ones to have been able to find my mother after searching for three days and take her to what resulted in a final resting place.

I vowed the day my own father murdered her that I would not allow another woman to be a statistic. Arlene Durham is doing the same as she shouts from beyond the mountain top for help in finding her best friend, Gail. That cry for help now includes the media.

Earlier today, on the show "Times Up" Arlene Durham was a guest on the live broadcast along with Robert H. Rarn, Retired Lt and Kim Anklin Criminal Analyst, principals in the firm Management Resources, Ltd., we discussed the missing person case of Dr. Gail Nowacki Palmgren.

Gail drove a four-door maroon 2010 Rubicon Jeep Wrangler with a black soft top. The wheel cover on the back has the words “Life is Good” and a daisy painted on it. The trailer hitch has a picture of the Disney character Goofy on it, and the Jeep has Alabama tags that read “EAZY ST”.

Gail is 5’8” and weighs 135 pounds. She has blonde hair and brown eyes.

Invitation to Former Cop: Come on My Show!

A few months ago, I was invited to be interviewed on A&E Biography on Drew Peterson who they were profiling.  My initial reaction was outage.  How is it possible for a man who, in my opinion, took the lives of Kathleen Savio and Stacy Peterson, to be given such importance?  

When I learned who as not going to be included in the hour long show, I agreed to be interviewed.  In my opinion, someone had to speak out on intimate partner homicide, a subject few know, understand or have survived.  One thing many may not realize is when you are interviewed on a show such as this, you are not paid.  Not one red cent went into my pocket, and never does, when I speak out in defense of these women.  I always do my best to be the voice for those who were silenced.

Some in the public forget that I was the daughter of a Chicago Police Detective.  After years of similar games, no different than Peterson, my mother was unable to get anyone to listen or provide help, she was murdered. My hero father, loved and revered by so many, took a gun and murdered my mother in cold blood.   He, too, could have gotten away with murder and lived, but as so many other cowards, he took the easy way out.   From that moment at the crime scene, after discovering their bodies, I vowed to change the way society swept the lives of women and children victims of violence and homicide off to the side as if it never happened; somehow I was going to prevent others like my mother from being murdered.  The programs, media, radio shows, books, lectures, trainings and direct services have saved thousands of women and their children from ending up like my mother.  

A former Chicago Police Officer by the name of Paul Huebl, who, by the way knew my father, decided to write about the A& E show.   While I believe that everyone is entitled to their opinion of my work, and I also believe in the presumption of innocence, even for Drew Peterson, I don’t believe it warrants a personal attack or name calling.  To personally attack me is attacking all the women who stand behind me for protection.

A comment left on Mr. Huebl’s site reads:

“That Milano douchebag blogger would not stop canonizing any woman Peterson ever slept with as a saintly victim including that drug addict. Milano is out of touch and her blog is nothing but re-written Hosey stories.”

He has been invited to be a guest on a future radio show, we will see if he accepts the invitation to discuss this case from both sides.

Family Courts "Splattered in Blood"

Sunday morning, three children ages 7,12 and 14 took their last breaths,as their father, during a court ordered visitation, Muhammed Goher, 47 of Houston, Texas opened fire. The school bags, neatly at the foot of the beds where the children were shot, splattered in their blood. Beanie Babies along the wall of the 7-year olds bed, soaked in her blood.

On Friday, Norma Goher, the children's mother dropped off the kids to their father, the couple was divorced, and he was to return them back to her on Sunday. The family court knew Muhammed was not stable and yet the judge went ahead and signed the order for visitation anyway. A hearing on visitation issues and removal of overnight visits with the father was scheduled for September 27th. In my opinion, one more time of court mandated "daddy time", cost the kids their lives.

There is an automatic presumption that it is in the best interest of a child “regardless of court orders”, prior violence or threats, to maintain visitation with both parents. Victims of domestic violence face a double edged sword. Either expose their children to imminent danger, or defy the court system refusing to allow visitation. Like so many others before her, Norma atttempted to deal with a violent relationship in a dysfunctional family court environment.

In family court the two parties are presumed to be on a level playing field--law abiding individuals who have a disagreement over a private family matter. A core assumption of family law is that family disputes are not criminal disputes. As such, there are few safeguards built into the family court system to protect against the criminal dynamics that dominate family disputes in cases of family violence. In addition, the accusations the victim makes in family court, no matter how serious, carry no more authority than one person's say so. One of the most serious consequences is that when a family violence victim opens a case in family court against her abuser, the abuser is given equal opportunity to fight back against the victim's accusations, often because the abusers past is not an issue. Unless, of course, he is brought in from county or state prison sporting an orange jump suit and leg shackles.

There are lawyers and men’s groups who argue using domestic violence with a broad brush is not a reason to deny fathers visitation with their children. Accusing mothers of lying or making up stories to keep fathers’ from their children.

Under the current laws, a parent without custody is entitled "reasonable visitation." There is a high burden of proof as evidenced in this case when a court refuses to take into account dangerous abusers pose to their children.

Until we place the issue of labeling these cases as a "private matter" or an isolated incident, expect the death toll among children to rise. Expect the courts to continue to ignore obvious danger signs when a victim of violence is or has ended the relationship.

After killing his children, he shot himself in the head, but remains alive and is expected to survive the attempted suicide.
