Crisis in Family Court: A Mother's Mission and Lifting the Silence

Back in September of 2009, just 5 months after Amy Leichtenberg's 2 boys Jack 7 years old and Duncan  9 years old were savagely murdered by their father during a court forced visitation, Amy gave an hour long interview.  During the show Amy discussed the steps taken to protect her children. Although her boys are gone, Amy's voice is not, she is shouting to stop the bloodshed of innocent lives.

The last time Amy saw her two boys alive, something was not right. Her estranged husband was acting out-of-sorts when they met at the police station. Amy refused to hand over her boys on March 7, 2009 an officer threatened her if she didn't give them to their father, she would be arrested according to her lawyer.

In 2007, Amy was awarded full custody of the boys with Connolly given supervised visitation. According to court reports from the family visitation center, Connolly's behavior was dangerous enough to temporarily cease all visits with the boys. In my experience, when a family visitation center terminates interaction between parent and child, it sends a red flag of danger. Connolly, the ever witty and clever abuser, was able to resume visits when his psychiatrist sent a "sympathy letter" to the judge "if my client is able to spend more time with his sons, Mr. Connolly's depression and outbursts would lessen."

The judge responded by setting a series of "behavioral guidelines." This included obtaining employment, housing and continued therapy.

In family court the two parties are presumed to be on a level playing field--law abiding individuals who have a disagreement over a private family matter. A core assumption of family law is that family disputes are not criminal disputes. As such, there are few safeguards built into the family court system to protect against the criminal dynamics that dominate family disputes in cases of family violence. In addition, the accusations the victim makes in family court, no matter how serious, carry no more authority than one person's say so. One of the most serious consequences is that when a family violence victim opens a case in family court against her abuser, the abuser is given equal opportunity to fight back against the victim's accusations, often because the abusers past is not an issue. Unless, of course, he is brought in from county or state prison sporting an orange jump suit and leg shackles.

There are lawyers and 
men’s groups who argue using domestic violence with a broad brush is not a reason to deny fathersvisitation with their children. Accusing mothers of lying or making up stories to keep fathers’ from their children.

Under the current laws, a parent without custody is entitled "reasonable visitation." There is a high burden of proof as evidenced in this case when a court refuses to take into account dangerous abusers pose to their children.

Until we place the issue of labeling these cases as a "private matter" or an isolated incident, expect the death toll among children to rise. And rise it has, with the recent murders of Charles 7 years of age and Braden 5 years of age on Sunday in the State of Washington.  Their father Josh Powell was the only person of interest since the boys mother Susan Cox vanished from the marital Utah residence on December 6, 2009.  Last week a judge ordered permanent placement of  Susan's children too her parents Chuck and Judy Cox.  However, as if this were a contestant game show Josh was given supervised visitation.  Josh Powell took an ax to each of his own children, doused gallons of gasoline in the home before lighting a match and blowing up the home.

Family Court Crisis: Rewarding a Killer Visitation for Charlie and Braden Powell ends in Murder

On Sunday, Charlie 7 and Braden 5, the children of missing Utah mother Susan Cox ,were murdered. The children were blown up in an explosion during a court ordered visitation with a dangerous psychopath.

Susan vanished on December 6, 2009 from her Utah home.  If you recall Josh Powell had suddenly, taken the children then ages 2 and 4; camping in freezing temperature at midnight.  When interviewed Susan was reported missing, the case covered by the media just prior to securing an attorney, Josh said he didn't know where his wife was and she just left.  In the days following, Josh would say she left with another man. He would be the only person named by police in the case.

As in each one of these intimate partner missing homicide cases, the last person to see their wife or girlfriend, is almost always the person responsible for making them vanish. The pattern of conduct in this case prior to Susan vanishing, then afterwards, is significant, and often overlooked by law enforcement.  Josh Powell was allowed to leave the state of Utah moving  into his father's home with the two young boys.

Many experts of across the country, Reporter Isabelle Zehnder, Statement Analysis Expert Peter Hyatt, Attorney Anne Bremner, Legal commentator and defense Attorney Holly Hughes, among others, discussed the imminent danger to the boys lives.  At one time or another we predicted if the legal system didn't remove the children, they would be murdered. Last week permanent placement of the boys was given to Susan's parents Chuck and Judy Cox.  Josh Powell by a judge was given supervised visitation like a prize for being the biological father. What was this judge thinking? Powell posed a threat to his own children's lives.

The murders of Charlie and Braden's were by all accounts preventable.

The family of Susan Cox requires not only prayers, but the promise that on the blood of their grandchildren, the epidemic and ignorance in the family courts across the country will do more than award murder's visitation and custody of children, especially when their mothers are missing intimate partner homicide victims!

Let's also remember Susan Cox is still missing and she requires our attention to be found.

The Sweet and Unassuming Perpetrators of Intimate Partner Violence


Profile of an Abuser

The abuser can be a male or female. The abuser can be sweet, handsome and unassuming to everyone, but you.

An abuser knows exactly how to manipulate all types of situations.

An abuser is the most generous and helpful person to the neighbor, your family, and friends. If you tell anyone you are being abused it is not likely you will be believed. When you are or were dating you thought it was “special” that this person was jealous of anyone who approached. Thinking how lucky you were until you moved in with them or married and the jealously turned into anger and rage, chances are you love this guy with all your heart and yet they still accuse you of having “secret affairs” or relationships with everyone else but, them.

The abuser is very insecure.

The abuser constantly questions your loyalty to them, the children and having a future together.

The abuser is clever at showing sincere intentions, but often has other motives

The abuser hurts or destroys family pets.

Jekyll and Hyde personality, they can be sweet one day and angry and violent the next.

The abuser is clever at showing sincere intentions, but often has other motives.

If you are pregnant, the abuser can become upset with you and angry and may attempt to make you miscarry. Once the child is born you may not be allowed to run and comfort your baby. An abuser expects the same attention and or sexual intimacy prior to the pregnancy.

An abuser may be unusually rough or use measures of discipline far too extreme on your child.

An abuser does not have the ability to love another person, is very critical of others.

An abuser blames you for everything that goes wrong in their lives; their job, outside pressures, whatever it is, you are blamed. Regardless of the situation; it is always your fault.

An abuser denies hurting you, almost acting like it never even happened.

The abuser will make excuses for why they become angry or physically violent.

The abuser blames their drug and alcohol abuse on you or their parents.

The abuser believes in maintaining control over every aspect of their lives to the point of obsession, including monitoring activities of you and or the children.

The Teeter Totter Abuser – remember when you were a child playing at the park? An Abuser rises you up and brings you down the same way as a teeter totter. One day they are driving you out of their lives saying things like “I have had it”, you are “worthless”

“I am leaving” to this is all “your fault” and beating you to “make you behave”.The next they are rising you up high by apologizing, sending you flowers, a card. They may actually cry or beg you not to leave them. They say things like: "I am sorry"; “It will never happen again"; “Don't you understand how much I love you?" They bring you gifts, or suggest a romantic weekend away. Suddenly they act as if they worship the ground you walk on. And acting as if they worship the very ground you walk.

Tarzan Abuser- their attitude and behavior is no different than “Me, Tarzan” (as they beat their chest) meaning they are superior to you, they are the “provider.”To “You, Jane” follow my lead, do as I say, be their slave, wait on their every desire, you are the invisible less important person in the relationship.

An abuser has an important career in the public, people depend on them for answers, and the abusive person brings this attitude home with them.

I cannot stress enough, if you are in a relationship that has a history of violence, simply mustering up the courage to confront the person and say it is over, without the proper tools, can cost you, your life!

One of the major reasons women stay in abusive relationships is fear. They are afraid of what will happen to them and their children if they leave. Sadly, their fears are often justified; statistics show that a woman is at the greatest risk for injury when she announces her plans or leaves an abusive relationship.

Randy "Amanda" Lehrer: Intimate Partner from Missing to Murder


Her body stuffed in a 55 gallon drum, encased in cement, discovered by law enforcement, hours ago in the New Jersey basement of the marital home, the remains of Randy "Amanda" Lehrer, age 32.

What is it going to take to stop the bloodshed? Mother's wanting out of their violent relationships, instead, filling up cemeteries across the county.

One significant change that must be implemented:
When a mother suddenly vanishes for the mental health of the surviving children; residential care must go to another relative. Randy's daughter was in danger. Anything could have happened while in the "care" of this individual. Care being the operative word since the child is too young to speak.

This is not about the law. This is not about guilt or innocence. It goes to the mental health and welfare of the minor children. In my opinion, the children are not in a healthy environment when left in the care of a potential "person of interest" or suspect.

Take the recent case of Susan Cox (Powell) her father-in-law just arrest on a multiple of charges that include child porn. Is that a healthy environment for the kids? No it was not.

In many of the intimate partner missing person suspected homicides the children are often in "the know" (if they can speak) as to what happened to their mother. Out of fear, the children are often silenced. Or they hear while in another room in the home enough to know "mommy is gone." Because of the unspoken fear, they remain quiet. A clever offender knows keeping the kids close they cannot be questioned by law enforcement.

Why not just do an automatic move of the kids when a report surfaces to a relatives home? With the understanding, the children cannot be questioned.

There are too many cases of intimate partner homicides, case after case where the surviving children suffer the most. I, as a homicide survivor of inmate partner related murder would like to see the State of New Jersey stand up and adopt policies within the current Statues to change not only how these I.P.V. cases are investigated, but, make allowances for the surviving children to thrive minus the fear of remaining in a mine field.

The husband was arrested and charged with Randy's homicide a few hours ago.

Randy Amanda Lehrer's life must have more importance to the State of New Jersey then another intimate partner homicide. When her daughter is old enough to speak, we have to be ready to do more then respond with a shrug of a shoulder while kicking the dirt on the ground.

An “Evidentiary Abuse Affidavit" and video has the additional psychological benefit of being forced to face reality and admit that the potential for the ultimate kind of violence exists…and that if it occurs the perpetrator will be held accountable.

Domestic violence or intimate partner victims now are able to provide information, in their own words, about the fears, dangers, experiences they have had at the hands of their abuser. The" Evidentiary Abuse Affidavit" or "EAA" records victim's stories, histories, and experiences which are preserved and stored on their behalf. These videos will provide answers to the many questions, allegations, and fears that arise when a person has disappeared, gone missing, or been found dead.

In relationships it is important to equip one's self with the proper tools before announcing "it is over." That, is what cost Bea Dickey her life. Unfortunately, hers life mirrors thousand of others across the county, victims of intimate partner violence, trying to break away from their abusive relationships with their lives in tact.

If Beatrice Dickey, or any woman found murdered or is reported missing, had done an Evidentiary Abuse Affidavit, ON TAPE, from following the information in the “Time’s Up" book ,they would be able to describe:

- threats made against her life or wellbeing, including details of how the perpetrator would carry out the threat
- incidents of past abuse that the victim has endured
- admissions or comments made to her about other victims or people abused
- where evidence or weapons would or could be located
- possible alibis that the perpetrator would make up in his defense (including identification of people who could be co-defendant’s or co-suspects)
- portray visible injuries or marks

Just think if we incorporate the only effective plan in the country and have it available for every prosecutor, law enforcement, church, family law office and social service agency across the country, lives would be saved.

Intimate Partner Homicide: The Writing is on the Wall

Statement Analysis plays an important role in crime. It is an accurate process by which a trained analyst explains language either verbal or written to determine truthfulness, deception and hidden information a person with direct knowledge uses when attempting to disarm others as to their involvement in a crime.

I refer to statement analysis as the art of unconscious vomiting of the truth. In cases of intimate partner homicide it goes to the deception of the truth.

Earlier today on The Roth Show, Peter Hyatt, Investigator and Statement Analysis Expert discussed his work regarding cases where husbands whose wives "suddenly vanish" play a critical role when they immediately hide behind a lawyer instead of helping in an investigation. After all this is their wife and mother of their children, yet when a person flat out refuses to cooperate it is deception.

We discussed the case of missing New Jersey mother Randy Amanda Lehrer, last seen on Friday, August 12, 2011. His deception in Randy's case begins with calling her place of employment and telling them "she returned to her native Canada to take care of her sick mother." The author of the statement is being deceptive which is one example of statement analysis. Like Pinocchio, Steven Acnua (the husband) was caught in a major lie.

The case of missing mother Susan Cox Powell who vanished on December 6, 2009, from Salt Lake City, Utah goes towards Josh Powell's use of words and sentences during media interviews the most recent when he and his father are interviewed on ABC's Night Line.

I know that when Walt Disney created the Pinocchio character he had no idea it could be applied to statement analysis, but it fits perfectly.

Every husband whose wife and mother to their children "suddenly" vanishes where they were the last known person to have contact with them are pathetic cowards. Those involved in intimate partner homicide are Pinocchio's minus a conscious and heart.

Over time their puppet like mentality, words and predictable actions will be the key to their own permanent jail cell.

Randy Lehre is 5'2", 145 lbs with a tattoo on her shoulder that says "laugh now, cry later"

The mother of a 10-month-child, Lehrer, 32, is 5 foot 2, weighs 145 pounds, has brown hair and brown eyes, and is of fair complexion. She has a tattoo on her right shoulder that reads “Laugh Now Cry Later.” Lehrer was lasted seen in public August 12 leaving her job at Tommy’s Restaurant on Central Avenue in Jersey City.

Jersey City Police Detective Cesar Camacho, is leading the investigation into Lehrer’s disappearance. Investigator Charles Hannon has put up a $3,000 reward for information leading to finding Lehrer. Anyone with information regarding Lehrer’s disappearance call 201-547 5427.
