Elizabeth New Jersey Violates Federal Law

"On October 29, 2010 I wrote a post titled "Murder in Progress: Elizabeth New Jersey." About a police officers wife whom found the courage after 13 years of abuse and threats on her life and that of her children's lives to press criminal charges against him. He is a commissioned police officer."

For the wife of any police officer whether they live in New Jersey, Chicago, Washington, Iowa, Florida or Kentucky, they all face a greater threat to their lives when they speak out as they end the relationship. On the post I wrote earlier I withheld the name of the victim. Tomorrow is the court date for this case. And the life of this officers wife and her 2 daughters is in grave danger.

Her name is Clara Colon. And, with good reason, she is in fear for her life. Earlier today Clara spoke with the prosecutor. She was informed that a plea deal has been reached and at 1:00 pm eastern time, on Friday January 14, 2011, Stafford Municipal Court in Judge Damin Murray's courtroom this case will not be tried. The officer will be charged with disorderly misconduct, pay a $500 court fine and go to anger management classes.

Clara Colon was allegedly told by the prosecutor that she was just a vindictive woman who is going through a divorce and you will not get anything and its all her fault. Then she asked Clara why she waited so long. Obviously, the prosecutor has little understanding, training or experience of the dangers involved as it relates to intimate partner violence and the legal system when your relationship involves a law enforcement officer.

The system in this case re-victimized and punished Clara Colon for pressing charges and asking the law to protect her. Suddenly a police report of facts has been replaced with a neat and tidy typed up report by fellow officers who are clearly not going to go up against the brotherhood of the badge. The assault and threats against her life with a weapon have been omitted from the "pretty report". In its place the word minor bruise on elbow. "He assaulted me, tried to kill me, but the brotherhood saved him."

There is still the investigation with the Internal Affairs Division in Elizabeth New Jersey but Clara said " what good is that, they are all his friends. And once he completes his "anger" classes if not before, his guns will be returned. "Hooray to the blue and the hell to the victim, your pain and suffering means nothing to the justice system. He will hunt me down and my daughters and murder us just like he has been threatening for over a decade."

No one changes overnight. "I want everyone to know, this man is a dangerous individual, that is being protected like the golden child by his supervisor/ brother who is a Lieutenant and others on the Elizabeth Police Department."

In real time we are seeing a dangerous pattern of conduct few officers wives survive. For women like my mother murdered by my police detective father she also echoed the exact same words. No one believed her while she was alive. They divorced after some 28 years of marriage. A few short months later, my father as do most abusive officers, made good on his promise.

So now what? Measures have been put in place for her safety since October and through the holidays, but it will not stop the bullet already marked with her name on it. There is no assistance for Clara or other women in her situation, we just wait and watch and ask why only after the tragedy.

But here is a question. Is Stafford Township in violation of a federal law? The Lautenberg Act says if you are convicted of a misdemeanor or a felony, you lose your job. Clara Colon's husband will plead guilty to a misdemeanor in court and yet he will retain his position as a sworn servant commissioned to serve and protect?

The Lautenberg Act:

In September of 1996, a federal law was passed which prohibits individuals -- including

police officers -- from owning or using a firearm if they have been convicted of a misdemeanor domestic violence offense (18 U.S.C. § 925). This bill, widely referred to as the Lautenberg Act, was passed as an amendment to the Omnibus Consolidated Appropriations Act of 1996. By modifying the Gun Control Act of 1968, the Lautenberg Act expanded existing federal law that only barred gun ownership from those convicted of a felony offense to include those convicted of a qualifying misdemeanor domestic violence offense. The offense does not need to be designated as domestic violence within state law, but is covered under the Lautenberg Act if it involves the use or attempted use of physical force or threat with a deadly weapon and is committed against:

• a current or former spouse,

• a past or present cohabiting partner,

• a person with whom the perpetrator has a child in common

• a person with whom the officer has or has had a dating relationship

(Individuals with a felony or misdemeanor conviction for domestic violence are ineligible

to own firearms or ammunition even if the offense occurred before the law was enacted.)

When is the justice system going to stop punishing victims of intimate violence? Where are her rights? An officer takes an oath to serve and protect, but their families are immune from receiving protection from the system when their lives are endanger.

Unfortunately, we will have to wait until after tomorrow's hearing to begin plan "B" in this case.

All anyone is asking is for the justice system to stop kicking the lives and safety of women and children whose abusers are in law enforcement, to the curb like trash on garbage day!

Coward With A Badge is Finally Captured

[former police office Derrick Yancey]
Special agents from the U.S. Department of State's Diplomatic Security Service (DSS) located Derrick Yancey in Punta Gorda, Belize. Yancey is wanted in Georgia for double murder of his wife Linda Yancey and a day laborer. Yancey on the run since April was arrested by Belize law enforcement and is awaiting return to the United States.

Yancey was a deputy with the DeKalb County, Georgia Sheriff's Department. In August of 2008, DeKalb County Sheriff's Office charged Yancey with two counts of murder. He was released on $150,000 bond awaiting trial under the condition that he be confined to house arrest. On April 4, 2009, Yancey violated the conditions of his bond and escaped house arrest. In June of 2009 America's Most Wanted featured the fomer officer on their show. Since then, he has been on the run, even eliciting the attention of television's "Americas Most Wanted."

On September 17, 2009, DSS agents in the Regional Security Office in Belmopan, Belize received an investigative lead from the U.S. Marshals Service and the Dekalb County Sheriff's Office on the possible whereabouts of Yancey. Within sixty hours of that tip, DSS agents in Belize were able to confirm Yancey's presence in Punta Gorda and locate his residence. On September 19, 2009, after extensive coordination between officers of the Belize Police Department and personnel in Diplomatic Security's Regional Security Office in Belmopan, both U.S. and Belizean law enforcement awaited Yancey's return to his neighborhood.

Upon arrival at a local bar, at 6:05 PM local time, a DSS agent tapped on Yancey's shoulder and told him "It is time to go." Belize authorities then arrested Yancey.

According to DSS agents, Yancey stated that he was surprised and shocked upon capture. Yancey also revealed he was relieved that he was finally caught and prepared to go home. DSS agents in Washington, DC and Belize will coordinate with The U.S. Marshals Service to arrange for Yancey's return in the near future.

"Diplomatic Security's regional security office in Belmopan maintains an excellent working relationship with local law enforcement personnel, thus enabling Yancey's capture," said, Edgar Moreno, The Bureau of Diplomatic Security's Assistant Director for Domestic Operations. "It's this type of close, worldwide law enforcement liaison capability that gives Diplomatic Security unparalleled ability to locate, pursue, and apprehend fugitives."

Counting Yancey's detention, Diplomatic Security has coordinated the capture of five of America's Most Wanted fugitives in 2009 alone, including previous captures made this year by authorities in Brazil, Nicaragua, Israel, and the Philippines.

Norberto Rodriguez Armed and Dangerous?

Two weeks have passed since Irma Rodriguez was found shot gang land style stuffed in the trunk of her car.

No press conference by the Oak Forest Police. No release of Norberto Rodriguez's photo. No talk of a reward. Not one word of where this former Chicago Police officer could be living after he murdered his wife.
On June 9th, family members in fear for their lives filed a court order of protection in Will County, Illinois in case Rodriguez suddenly appears. Perhaps the family can meet with law enforcement and have the case information posted on America's wanted with his description and photo.

A man takes a life paralyzing not only a family, but a community. It is likely Norberto Rodriguez is also armed and dangerous. Where is the outrage?

According to "Legal Roaster" Cops Held at Higher Standard?

Earlier this week a judge denied bond for the former Georgia Police Sgt.Sam Parker charged in the murder of his wife Theresa Parker whose body has not been found.

Theresa Parker vanished in March of 2007. And the couple were finalizing their divorce. So the former officer will remain in jail. A trial date has not been set.

And what about Georgia Sheriff Derrick Yancey from Atlanta who paid the $150,000 cash bond after being charged with the murders of his wife Linda Yancey also a police officer and a day laborer. They put him on a home monitoring device. Tweleve hours later it was discovered that he escaped and has been on the run for 7 weeks. Anyone with information on Derrick Yancey's whereabouts could go to the http://www.amw.com/fugitives/brief.cfm?id=64701 Web site, or call 1-800-CRIME-TV.

Then their is Drew Peterson charged with the murder of wife #3 Kathleen Savio who sits in a Will County jail awaiting another hearing on Thursday, May 21, 2009. Apparently my favorite legal marshmallow roaster made a comment on one of the talk shows claiming "cops are held to a tougher standard in domestic violence claims against them." What planet has he been practicing law? "Abusers R US?"

Fact is law enforcement officers are not held to any such standard as it relates to police perpetrated crimes in the home. For more on the subject go to part 2 of the Drew Peterson series with myself and Robin Sax over at Women In Crime Ink.

Lending Your Voice's

"She wrote in that computer, 'I don't know all the future holds for me. And I'm scared of what will happen in the future'..."

On Monday, April 27, 2009, Robert Vanaman who plead guilty to his wife’s murder last month will be sentenced before a judge. Many are concerned the former cop will not receive much of a sentence based on the fact he and his family are well known in the community. But, you have an opportunity to make a difference and be heard. The family has requested letters to be sent to the judge.

We [the family] are asking that letters be addressed to: The Honorable Judge Martin Herman. Please let him know how you feel and what you think. You must sign the letter. There cannot be any anonymous letters. Please fax your letter to (856) 447-1169 by Monday morning. In advance, the family of Barbara would like to thank you for your help and cooperation.

Please consider lending your voice in hopes the judge does not give Robert Vanaman probation or a reduced sentenced.

Derrick Yancey Double Murderer Escapes From House Arrest & GPS Monitoring Device

A double murder suspect released on bond, placed on house arrest slipped out of his GPS device and escaped.

Eleven hours later the monitoring company alerted officials, Derrick Yancy, 49 years of age is missing. According to his attorney who says his client is innocent the poor soul had been depressed for several days. No telling where Yancey went, he is armed and dangerous.

The former DeKalb County, Georgia Sheriff, charged with the double murder of his wife Linda Yancy and day laborer Marocal Puluc was allowed to make bail and placed on house arrest in August of 2008.

Now, armed and dangerous Yancy is on the run. Why isn't he behind bars?

This case has had a foul odor from day one!

Anyone with information should call the DeKalb Sheriff's Fugitive Squad at 404-298-8200.

The Circus Returns

Drew Peterson is resurfacing, this time he and he legal marshmallow roaster will appear on the CBS Early Show to discuss an upcomming book by a self-published Canadian businessman to be released later this week.

The front cover of the book has 2 photo's one of Peterson hooked up to a polygraph machine and the other is a family portrait with Stacy, Drew and all four children taken a couple years ago.

Will County is no closer to charging and arresting Drew Peterson on either Stacy Peterson or Kathleen Savio. And as an important side note to this circus lets not forget Lisa Stebic.

In this game of catch me if you can, with the one anniversary of Stacy's vanishing act at the end of October one wonders if James Glascow's Prosecutors have presented enough of a case for a grand jury to even indict Peterson?

Too many questions and not enough answers in domestic violence, vanishing, murder, stalking, and felony cases not only in Illinois but across the Country.

If nothing else this should be a wake-up call to the Department of Justice. This is your front row seat to real life tragedies within our legal system .

Now, let's get busy and fix the problem!

"Luckiest Girl in Texas" Is Murdered By "The Perfect Abuser"

By: Susan Murphy-Milano

" luckiest girl in Texas."...

"Female 26 years old AMARILLO, Texas United States

MySpace Last Login: 9/5/2008

The above photo is of Amy Yager, taken from her myspace page. She is not so lucky, on September 12, 2008 in her home, Jeff David Yager, a Federal Officer, beat the luckiest woman in the world. Then he finished her off and fired 2 rounds into her body. One to the torso, the other at close ranger to her head.

Below is Jeffrey David Yager. The photo caption on my space says "MyBaby and his gun"

This big tin badge coward, murdered his wife. He sits in a Texas jail. Could he or someone post the $25,000 cash required to get out of jail until his trial? It is a possibility.

A news story appeared in a Texas paper on the murder and I was outraged by commentary left by readers claiming to be friends or realted to the couple here is a sample:

"i think a lot of you that have wrote these blogs should be ashame of you're self .you don't know how it is to come up with nothing and try to make something of you're self DAVID GREW UP WITH A HARD LIFE .I KNOW BECOUSE I WAS THER TO SEE HIM EVERY DAY .I KNOW WHAT HE DID WAS WRONG BUT THERE IS A WEAK SPOT IN EVERY ONE OF US .HOW MANY RICH PEOPLE HAVE KILLED IN A BIT OF ANGER? THIS COULD HAVE BEEN YOU JUST AS WELL AS AMY CLEAN UP YOU'RE ON BACK DOOR THEN WORRY ABOUT OTHER PEOPLE'S PROBLEMS HE HAS TO ANSWER TO GOD NOT YOU. YOU DON'T KNOW THE WHOLE STORY. DAVID IS A PART OF MY FAMILY SO I KNOW HOW HE GREW UP . THINK WHAT YOU MAY IT COULD BE YOU NEXT TIME."

Blaming, making excuses, all because we know the person arrested for the crime has become common in our society when a husband or an ex murders their spouse or significant other. Sorry but the friend or relative has not a clue about violence in the home or what a woman similar to Amy endures. And if you would like to send me nasty words in an email or on this blog I suggest you do your homework on my background, first.

When the tragedy was broadcast by the local media , a plea of sorts was sent out asking the public for any information they could provide in the case. Seems very clear cut to me. I was stumped as to what other information they [the police] are seeking? And this is what most of the news organizations asked: A motive for the crime was being investigated. Anyone with information should call the special crimes Tnit at 378-9468. The police are asking the public for a motive??? Again, you have the shooter, the weapon, and the body. Is there any question about that? If they are so concerned and wish to wast manpower begin by checking the police department phone call logs just two nights before the shooting. Didn't Amarillo Police respond to a domestic disturbance call at the home of the Yager's?

There are no room for questions, doubts or stone throwing in this case. It is simple. Jeffrey David Yager Murdered Amy Yager in cold blood.

Today, Amy was laid to rest. It is important to me as the daughter of a law enforcement officer who murdered his wife, and my mother, that changes on how these cases are handled, charged and reported come out of the stone age and into the twenty first century.

Stop sugar coating these cases at both the felony and misdeameanor level. Redirect how they are reported in the media. Train Officers to see the signs within their own units.

Amy Yager, and the thousands before her, did not have to die because someone demanded power and control over their lives.

There's your investigation summary!

Georgia Deputy "Yellow" Yancey

"Cowardly Tin Badge Georgia Deputy" Derrick Yancey

In June if this year, Linda Yancey and a day laborer named Marcial Caz-Puluc were found shot to death in the home of Deputy Yancey. Yancey claimed that the day laborer shot his wife Linda and he then shot him.

From the beginning this wreaked of a set-up. Yancey was angry that Linda wanted a divorce from her controlling abusive husband. According to sources "no way" was Yancey going to "allow" his wife to "take half of anything."

Yancey thought of a fairly good plan. He found a man who could not speak english and had no family. He hired the day laborer to do landscaping around the house, his wife would be home. It was almost the perfect crime. He lured the man into the house after killing his wife, then he killed Caz-Puluc.

Deputy Yancey's story-"he killed my wife and I shot him". Neither Yancey's story nor the crime scene held up. It fell apart and he was indicted on two counts of murder.

Now there is another issue, Deputy "Yellow" Yancey worked for eleven in the very same court house where he will be tried. Under the circumstances, Yancey's case needs to be moved to a different courthouse.

This tin badge coward was unable to walk away and settle personal and financial issue's with his wife Linda Yancey, like a man.

Atlanta Deputy Submits to DNA in Wife's Murder

(Home where Linda Yancey was murdered)
Atlanta-It has been more than a month now since the murder of Linda Yancey. Her Deputy husband, Derrick Yancey has claimed she was shot by an intruder. Then the intruder who Derrick Yancey hired to perform landscaping at this home claimed that is who shot his wife. And Yancey's claims to have shot him.

Finally, a bit of movement in the case. Derrick Yancey submitted to DNA testing.

Interesting comments from an earlier post on the case. One of the comments said:

"Derrick was going to prevent Linda leaving anywat possible. When he first learned

of her plans to end the marriage and file for divorce he went absolutely nuts. "

I would suggest if anyone has any information they should contact the authorities. You can always call and leave a tip without using your name. Or if you have any supporting evidence, please provide it to the proper authorities.

It is important to wait until the police conclude their investigation.

My opinion on the case stands. It smells foul!
