Former Police Officer Bob Ingel
The family of Becca McEvoy returns to court today in Mobile Alamaba fighting for justice for a little girl they say was raped by her police officer stepfather, Bob Ingel. Rebecca McEvoy, 11, was killed in a car crash last January.
Before she died, unexpectedly, Rebecca had been before the grand jury, testifying in hopes of seeking justice against this alleged sexual predator. According to prosecutors, a medical exam confirmed Rebecca had been raped, but Ingle's attorney is hoping a 2004 Supreme Court ruling will keep the case from ever going to trial.
Today, a Mobile County Judge is expected to decide whether a defendant can stand trial without having an opportunity to confront his accuser.
The lawyers are using the "Crawford" case out of Ohio. This says “you have the constitutional right to cross examine your accuser” and because the girl is dead and cannot testify, there is a chance the Judge may throw out the case.The Assistant District Attorney, Steven Giardini, believes the case law should not be applied in Becca McEvoy's case.

Why oh why does our world have to have so much ugliness in it. This poor child not only lost her innocence at the hands of this step-father, but now has lost her life. Is there no justice that someone may even have half a chance of going free because of a technicality in the law?

Justice Delayed is Justice Denied! Court Postponed for 5th Time to June 10, 2008
"I just want to know where the victim's rights are for a speedy trial. This is the fifth time that this has been reset." said McEvoy.
Rebecca's Father Aden McEvoy is worried statements his daughter made before her death won't be allowed as evidence in the trial, because of a law that guarantees the defendant’s right to cross examine a witness.
Defense requested postponement so they could sit down with medical exam doctor & discuss his findings. Request was originally made on april 2nd then rescheduled 2 more times, to give them the time they need to get med exam squared away. A month and a half isnt long enough?

The defense is asking that the case be THROWN OUT!
We have heard back from the Court of Appeals and Steve Giaridini with the D.A's Office here in Mobile,Al. in the case of Rebecca McEvoy.
As you all know the evidence was sent to Montgomery to the court of appeals by the defense. DA Giaridini says the Court of Appeals has denied the request to have Judge Youngpeters decision overturned.
The defense is now having it sent to the Supreme Court and all though it's not written in stone in looks good for now.
The D.A. says it will probably be ready to trial sometime early 2009. Possibly around May. Keep us in your prayers and pressing for "Becca."
