The State of Oklahoma Holds Justice Hostage for Sheila Deviney

On Wednesday, the unsolved homicide case of Sheila Deviney, murdered on January 6, 2004, was featured on The Roth Show.  Joining us for the hour were Sheila's parents, Susan and David Deviney.  Running for election in 2010, then candidate and now Garvin County Sheriff, Larry Rhodes, promised to open up the investigation if, and when ,he was elected into office.  Sheriff Rhodes campaign platform was the combined cases of the "Garvin County Three", which included Sheila Deviney.

In September the State of Oklahoma plans on destroying the only tangible evidence, tissue samples that tell the story.  How is it possible to destroy evidence from an unsolved homicide?  The pictures below were taken after the fire in which Sheila Deviney died.  They tell the truth along with other important information. There is no doubt, this case is an intimate partner homicide.

At some point in the near future there is a possibility I will be returning to Garvin County as I did in the fall of 2010.  Hopefully, OSBI, The Attorney's General's Office and others in the state will provide assistance for the Deviney family.  All the family wants is justice.  Is that to much to ask?

Tia Bloomer: Murdered in The Name of Love

It should go without saying that when a person is hit, grabbed by the neck, or punched the first time, you get the hell out and far away as possible.  We wouldn't allow a perfect stranger to do harm and cause injury, we'd immediately press charges.  Yet, young women of high school age are remaining in violent and abusive relationships, all in the name of love.

Love is what got a beautiful Tia Blommer, 19, and the mother of a small child, murdered by her on-again-off-again boyfriend Isaiah Tryon.  The young couple had a history of violence.  They'd met while she was still in high school and had a baby together.  From the start of the relationship it was violent.  In 2009, after an argument he shot at Tia in a hotel parking lot.  The boyfriend pleaded guilty to four counts of assault with a dangerous weapon and one count for possession with a firearm.  The judge convicted this dangerous individual to a 10-year deferred sentence.

Tia continued to see him, because she both loves and fears him, a common thread in violent relationships. The next reported incident, and I believe other incidents happened but police didn't make a full report and or Tia was too fearful of what Tyron would do, he fired a gun at Tia while she held their 2-month-old baby.  He was arrested and charged.  But, here is where prosecutors in Oklahoma failed to do their jobs; they didn't use their "automatic"go to jail card already on the table from the 2009 incident.  Tryon is on probation a deferred 10-year sentence, he should have immediately gone to prison. What were the prosecutors thinking?  They had a chance to revoke his probation and blew it.  Incidents of violence to Tia continued and so does deferred sentences for Tyron.

To a violent offender this type of a slap on the wrist by the criminal justice system is viewed by the criminal of intimate partner violence as a reward.  Translation for the offender, they will walk and not do any prison time.  For the victim, who see's no consequences to the violent person with whom she is involved, it's accepted practice, not taken as a serious crime.

On Friday, at a Oklahoma bus terminal as a dozen or so people were standing around, Tryon began beating and stabbing Tia.  By the time he was pulled off and cuffed, her injures were life-threatening and she died shortly after at the hospital.

Her mistake was calling Tryon telling him she was at the bus terminal, informing him the relationship was over, that she'd had enough.

Tia Bloomer like so many victims across the country do not have the support by their community nor the understanding that violence in a relationship will get you killed.

Society has yet to view intimate partner violence as a crime. Now another young child will grow up without their mother, making periodic visits to a cold cemetery where they will place flowers at Tia's resting place.

Tia Bloomer lost her life in the war known as intimate partner homicide.

Trisha Stemple Justice Served as the State of Oklahoma Executes Her Killer

 

In the early morning hours of October 24, 1996, Trisha Stemple, was brutally murdered. Her body was left on the side of U.S. Highway 75 in Tulsa County, Oklahoma.

Her husband  Timothy Shaun Stemple was charged and convicted of the killing of his wife.

At trial the prosecutor's case was strong proving to a jury Timothy Stemple concocted a plan to terminate the life of his wife, Trisha Stemple, and to collect her life insurance proceeds. Stemple was having an extra-marital affair with Dani Wood. Dani Wood had a sixteen year old cousin, Terry Hunt. According to Hunt, Stemple offered him $25,000 to $50,000 to help kill Trisha (if they collected the insurance money).  Hunt recruited another person, to assist in the plan. Nat Helm and Hunt went to Wal-Mart where they purchased a baseball bat and plastic wrap. The
plastic wrap was wrapped around the bat to keep the bat from getting bloody.
On October 10, 1996, Hunt and Helm went to the designated location on highway
75 and waited for Stemple and his wife to arrive. A while later Stemple drove up and
told Helm and Hunt that Trisha was ill and he could not get her to accompany him.

Two weeks later, Stemple arranged for Hunt to drive Stemple’s pickup to a particular
location on highway 75 and leave the hood up. Stemple and Trisha arrived in their
black Nissan Maxima. Stemple began working on the truck and Trisha stood next to
the truck. Hunt came up behind Trisha and hit her in the head with the bat. The blow
did not render Trisha unconscious, so Stemple took the bat and hit her several more
times.

Stemple and Hunt then placed Trisha’s head in front of the front tire of the pickup
and attempted to run over her head, however, the tire would not roll over Trisha’s
head so her head was pushed along the pavement. After this, Trisha tried to get up.
Stemple grabbed the bat and hit her several more times. The pair then placed Trisha’s
body under the truck and drove over her chest. Trisha rose up on her
elbows, so Stemple hit her again several times with the bat.

Stemple then went back to the black Nissan and drilled a hole in the front tire to
make it look as if Trisha’s car had a flat. One expert testified that the hole in the tire
had spiral striations consistent with drilling. Stemple and Hunt left in the pickup, but
decided to turn around to make sure Trisha was dead. When they got back to the spot
where they left Trisha, they noticed that she had crawled into the grass beside the
road. Stemple then sped up and ran over Trisha as she lay in the grass.

Trisha’s body was found later that morning, after Stemple called reporting that she
was missing. The autopsy evaluation revealed that Trisha had fractures to her arm,
ribs, pelvis, vertebrae and skull. The medical examiner concluded that Trisha died
from blunt force trauma to the head.

After years of unsuccessful appeals, today, at 6:00 PM Central time Timothy Shaun Stemple will be executed by lethal injection for the murder of Trisha Stemple.

On a Website called FreeShaun.com a letter written by Stemple on March 5, 2012, claiming his innocence  posted for the world to read.  A jury sent a message when Trisha Stemple, mother of two was brutally murdered.  Trisha's voice silenced, as so many victims of intimate partner violence leading to homicide are, across the county by those who profess to love them.  The Governor of Oklahoma as of yesterday, does not intend on issuing a stay of execution for Stemple.

Today, Trisha Stemple has the last word as the angels sound their horns for justice!

Garvin County Oklahoma Meets Murphy's Justice in the Unsolved Murder of Sheila Deviney

In Gavin County, Oklahoma, a new sheriff by the name of Larry Rhodes was elected with promises to change the good old boys style justice.  In the fall of 2010, the Turner, Deviney and Horton families, (also known as the Garvin County Three) and myself were assured the cases would each be re-opened and investigated if and when Mr. Rhodes got elected.   

I wanted to give the now Sheriff Rhodes time to get settled into his new office, elected in case it slipped his mind, by the people.  He fought a good race and won because citizens in the community believed in his voice and action for change.  Last week I learned that Sheriff Rhodes has no intention of re-opening and investigating the Sheila Deviney unsolved homicide case.

Tara Johnson and Daughter Allison and the Million Dollar Question

On Tuesday, mother and daughter were found dead in Oklahoma.  And by Wednesday,at a hotel room in Las Vegas, the husband and father was found, he'd committed suicide.

Tara Johnson, 29 and her 16 month -old daughter Allison were murdered.  The couple "appeared loving and happy."   There were no financial issues and no signs of any trouble or abuse in the couple's marriage.  Yet, David Johnson murdered his family.

In cases of intimate partner violence leading to homicide, the silence of not telling their shameful secret to friends and family can be common.  In many relationships, a victim is embarrassed, refraining from disclosing to anyone, even their closet friends they're being abused. A victim can falsely believe they can handle the abuse.  The victim loves the person so much she has a false sense of safety, thinking the situation will never escalate to the point the person will actually kill them, or their own child.

We see this pattern in cases of intimate partner homicide over and over.  There is no making sense of these cases, especially when a father who participates in the upbringing of their own daughter, takes her innocent life.

Everyone who knew the couple will always wonder and then ask my least favorite question in cases of intimate partner homicide; what drove David Johnson to commit murder?

Tonight on Murphy's Justice case of Sheila Deviney, found burned to death in her Maysville, Oklahoma home in January, 2004. Her death was originally categorized as an accident, but later deemed a homicide which is still unsolved. Through the years the family of Sheila Deviney have tirelessly sought justice, all the while meeting obstacles along the way as her case has grown cold.

Sadly this case is all too common. Victims of intimate partner violence who seek custody of their children and have taken steps to end a relationship before, during or as in Sheila Deviney's case after a divorce are silenced by their abusers.

There is a $50,000 reward being offered to anyone who comes forward with information that will put the killer(s) behind bars. But first, the good people of Garvin County need to start demanding answering because as of now Sheila Deviney's homicide case is not being investigated.

Oklahoma's New Law: Finally, Justice For The Dead

Its been just over a year since I was in Pauls Valley Oklahoma with the families of the Justice For The Dead site. A group whom came together for one sole purpose, to reform the Oklahoma Medical Examiner's Office headed up by attorney Jaye Mendros.

This past week the Chanda Turner Reform Act went into law. Families will now have the opportunity to appeal their loved ones' death certificates. Numerous cases across the State in which the Medical Examiners Office rubber stamped death certificates as suicides, many without autopsies or proper testing. Some of their actions were political corrupt. Contaminated and even manufactured crime scene's appeared in the majority of the cases.

One of many disturbing, still unsolved cases to benefit from the new law is the intimate partner homicide of Sheila Deviney 30, who died on January 6, 2004, when her mobile home, located about one mile east and one mile south of Maysville, Oklahoma, burned to the ground. She was murdered. It should be no surprise that Sheila had been married to an abusive, controlling man. They had a court date over past-due child support scheduled the next day. According to eye witnesses, her ex-husband was at the home, although by law not allowed on the premises. He and others according to recorded, notarized and sworn affidavit statements I have in a secure location from eye witnesses attest to certain individuals leaving Sheila's property as flames jumped into the sky. Witnesses say those person's allegedly destroyed evidence and took items from the home.

Since the murder of Sheila, her parents Dave and Susan Deviney have worked along side the other families seeking justice. Sheila's case has more twists and turns than a tornado.

Tissues sample's from the fire need to remain in tact and not destroyed as threatened by the Medical Examiners office within the next few months. This is the only tangible evidence. Law enforcement allowed a suspect to destroy physical evidence within days of the massive fire that took Sheila's life.

Is it a coincidence that the spokesperson for the Medical Examiner's office, Cherokee Ballard resigned on the very day this law went into affect?

Susan Murphy Milano and Jaye Mendros stand with the families

Last year the Crime Wire Team shined a light onto the plight of families dealing with the corruption and ineptitude of the Oklahoma Medical Examiner's Office. Several families seeking justice for their deceased loved ones banded together, along with Oklahoma City attorney, Jaye Mendros, and formed Justice For The Dead to publicize the need for reform. Out of that union The Chanda Turner Act came into being, and after a long battle through the Oklahoma legislature, it has been signed by the Governor.

Caravan "Catching a Killer" and DNA

Brutally raped and murdered, Brittany Phillips will never get the chance to experience her mother's warm embrace again. While away at Tulsa Community College, Brittany and her mother, Margaret Zingman, regularly talked every Monday and Thursday. These weekly phone calls would soon end the night a police officer knocked onDr. Margaret Zingman's door, to inform her that her daughter had been raped and murdered.

For Brittany's mother, such violence against her daughter is all too familiar. "All my work did not prepare me for the events of Sept. 30, 2004"
As a psychologist at Mabel Basset Correctional Center, and a trauma therapist for 17 years, Dr.Margaret Zingman could never imagine her personal experiences and work with other victims would run parallel with the death of her daughter. The stories she hears on a daily basis from the women she works with is now a harsh reality for her. With a donated van, Dr. Maggie Zingman prepared for her first road trip in 2007. Since then she has driven to countless states and cities in hopes of catching a killer. Now, thousands of miles, caravan trips, and over 2,000 ruled out DNA possible suspects later, she continues visiting homicide units, college campuses, and sporting events like the PGA tour, passing out the killer's information in hopes someone may provide a tip or a lead.

Her daughter, Brittany Phillips, was found raped and suffocated inside her Tulsa apartment in 2004. Britty, as she's called, was buried on her 19th birthday.

When she has saved up enough vacation days at work, using her own money she carefully plans the road trips driving in towns across America in her SUV, a moving billboard that literally tells the tragic details of a young woman's life abruptly taken away.

Dr. Zingman understands the new technologies that allow tiny bits of DNA found at crime scenes to be scooped up and tested. While on the road she spreads the word of new federal and state laws requiring law enforcement to collect DNA samples from people convicted of-- or simply arrested for -- nonviolent crimes, including shoplifting. She is advocating for every State to do a DNA test upon arrest.

Police have Brittany Phillip's murderer's DNA and because of this "Teflon mom" thousands of men have been tested, but no killer has been found, leaving Brittany's mother motivated to continue to ride in search of the man who brutally took her child's life. Some would argue that Maggie is looking for a needle in a haystack and the killer may be never be found. "Once chance in a million, is better than no chance at all."

Dr. Maggie Zingman plans to do another road in a few weeks. She will not stop until Brittany's killer is found.

Her boyfriend claimed she shot herself while he slept through the sound of gunfire, then found her outside on the backsteps after she was dead. Crime scene photos depict blood throughout the inside of the home, including on the mattress he claimed he was asleep on. The mattress had been stripped of sheets; no one asked where they went. There were more signs of clean-up in the bedroom, including a bottle of cleaning solution on the floor. The boyfriend had fresh scratches on his arms, and Chanda was covered in bruises. There were signs of a struggle in the livingroom, including broken furniture. The medical examiners officer ruled the murder a suicide.
