Segment 1:

In 1971 Joan Butterbach vanished and for almost 6 years her family had no idea where she was, or why she was gone.  In 1977, Mark Van Osdale, 16 at the time, was fishing on Lake Tainter when he saw something strange protruding through the surface of the water.  What he saw ended up being Joan Butterbach’s car, with her body in the trunk.  According to the Dunn County Medical Examiner, Chris Kruse, ”The car was rigged to propel itself into the water without a driver.”

Guests include Christopher Kruse, Chief Medical Examiner for Dunn County Wisconsin, and family spokesperson and Crime Wire Director of Research, Kim Kolton.  Questions have been raised about the fact that some individuals knew about the submerged car, and what went wrong in the original investigation.

Segment 2:

On September 4, 2008, 33-year-old Daniel Ray Underwood, his girlfriend Rebecca Nelson, and a friend, Maria Harvick, were at a bar in East Fork, Texas. The three then went back to the home Daniel and Rebecca shared in Springs, Texas. According to Maria, once there, Daniel and Rebecca got into an argument and Maria left the room. A short time later she went back into the room and saw Daniel holding a shotgun in his right hand and accusing Rebecca of taking all his money and burying him in debt. Rebecca grabbed the gun and a struggle ensued. Maria again left the room, and a few seconds later she heard the gun go off. When she stepped back into the hallway she saw Daniel fall to the floor, mortally wounded.

Was Daniel’s death an accident, a suicide, or a homicide? The answer might depend on who you talk to and when.

Playing A Game of Texas Hold'em with Justice: The Daniel Underwood Case

The case of Daniel Underwood, 33 of Sulfur Springs Texas was featured on Wednesday's the Roth Show. On September 4, 2008, during an argument took place with his live-in-girlfriend at the time, and according to witness Maria Harvick, Rebecca Nelson had her hand on the trigger and the sawed off shotgun went off. The bullet struck Daniel through chin up to his face and his head.

Does the girlfriend Rebecca Nelson immediately render aide to Daniel?

Does the girlfriend Rebecca Nelson immediately call 911?

Does the girlfriend Rebecca Nelson assist Daniel as he is chocking on his own blood?

The answer to all three questions is no!

Does the girlfriend Rebecca Nelson cover and smear her own arms, face and clothing with Daniel's blood?

Does the girlfriend Rebecca Nelson tell the other person in the room when she pulled the trigger

to tell police Daniel shot his self?

Does the girlfriend Rebecca Nelson instruct the other person in the room to say to the police that she and Daniel were not arguing or in a struggle and that she was not near the gun when it fired?

The answer to all three questions in blue font is yes!

The evening of the shooting Rebecca Nelson is interviewed by police. Notice that in the video below she asks the police for Daniel Underwood's wallet. First, they are not married. Second, the credit cards in Daniels are his not hers. He was her sole support. She never even owned a credit card. When she is denied the wallet, Rebecca Nelson ask again and they tell her it would be up to his parents to return or work that out. Her tactics for the moment fail.

After she leave the police station, she returns back to the home, while Daniel is being given his last rites and takes everything from a laptop, pool sticks, and other items that can be pawned.

The Good Old Boys of Texas and Justice for Daniel Underwood

Earlier today on the show "Time's Up we brought to light, in my opinion, the Intimate Partner Homicide of Daniel Underwood from Sulphur Springs, Texas.

On

September 4, 2008: 33-year-old Daniel Ray Underwood, his live-in girlfriend Rebecca Nelson,and a friend, Maria Harvick, went from a bar in East Fork, Texas and then back to Daniel's private home where an argument erupted, a struggle ensued, a shot gun fired, and Daniel was mortally wounded. But was it an accident or a cover-up by police?

Daniels mother, Donna Underwood, whom has fought for justice and Maria Harvick who was there that fateful night along with Dennis N. Griffin retired investigator and author were on the show.

New information important to the case was revealed for the time. These developments are enough to ask the Attorney General's Office in Texas to review the information and ask that the case be re-opened to have the medical examiner change the cause of death from suicide to homicide.

The witness that evening Maria Harvick provided a first hand account into what really happened to Daniel Underwood. To describe that here on the blog is better served in listening to the broadcast link provided below. Past attempts by the family to the Sulfur Police Department asking in writing to re-open the case have fallen on deaf ears.

That night Rebecca not only fires the shotgun, she moves the body and then does something in my opinion, that is repulsive.

At the center of this case is an individual who planned the murder and succeeded at disarming law enforcement, likely because she is a woman.

Danielle Hill Alvarado" This Case Deserves Attention"

Answers are few when a young mother simply vanishes without a trace. And that is exactly what happened to Danielle Hill Alvarado Hill on January 24, 2010. This is another young woman having difficulties in her marriage who would never leave behind her 5 year-old daughter.

What we do know is that following church service she went with her mother to a baby shower. From there she went straight home. The last known person to have seen her was Johnathan, her husband. He is not a suspect nor a person of interest. My question is should he be?

Just 2 months before she vanished Johnathan was arrested for aggravated assault against Danielle, in November of 2009.

According to her mother her daughter was afraid to return home after the baby shower they attended together. Her husband was furious because she went to the function after he told her she could not go. Her mother begged her not to go back home but her daughter said if she did not her punishment would be far worse.

The circumstances surrounding her vanishing is not enough at this stage to make an arrest, but it clearly is enough to do a proper investigation on this case.

Has the Wichita Falls invited the husband to take a poly graph? If not, why not?

Has the marital residence been searched by law enforcement and cadaver dogs?

If not, why not rule out that out as a possible crime scene? After all she was last seen going into her home.

"Wichita Falls Police say they are treating this as a missing person case and are continuing to work on leads." I mean no disrespect to law enforcement when I say, perhaps that is the problem and to consider working the case as an intimate partner homicide.

Caravan "Catching a Killer" and DNA

Brutally raped and murdered, Brittany Phillips will never get the chance to experience her mother's warm embrace again. While away at Tulsa Community College, Brittany and her mother, Margaret Zingman, regularly talked every Monday and Thursday. These weekly phone calls would soon end the night a police officer knocked onDr. Margaret Zingman's door, to inform her that her daughter had been raped and murdered.

For Brittany's mother, such violence against her daughter is all too familiar. "All my work did not prepare me for the events of Sept. 30, 2004"
As a psychologist at Mabel Basset Correctional Center, and a trauma therapist for 17 years, Dr.Margaret Zingman could never imagine her personal experiences and work with other victims would run parallel with the death of her daughter. Dr. Zingman understands the new technologies that allow tiny bits of DNA found at crime scenes to be scooped up and tested. While on the road she spreads the word of new federal and state laws requiring law enforcement to collect DNA samples from people convicted of-- or simply arrested for -- nonviolent crimes, including shoplifting. She is advocating for every State to do a DNA test upon arrest.

Police have Brittany Phillip's murderer's DNA and because of this "Teflon mom" thousands of men have been tested, but no killer has been found, leaving Brittany's mother motivated to continue to ride in search of the man who brutally took her child's life. Some would argue that Maggie is looking for a needle in a haystack and the killer may be never be found. "Once chance in a million, is better than no chance at all."

Dr. Maggie Zingman plans to do another road in a few weeks. She will not stop until Brittany's killer is found.
